Denied Justice in Fundamental Rights Case SC/FRA/87/2025 – Urgent Global Appeal

I, Sathienthira Thiagarajah, respectfully appeal to the global community for support in my case SC/FRA/87/2025, where my fundamental rights, political participation rights, and financial rights have been violated without compensation or remedy.

 
Details of the Incident:
In 2025, the Sri Lankan Election Commission announced political party registration after years of delay but gave only 14 days to complete registration.
This short notice made it nearly impossible for small parties to register fairly.

During this time:

I was actively trying to find a lawyer to file my case, but lawyers demanded around 25 lakhs Sri Lankan Rupees to handle it, which I could not afford.
Later, I found an advocate who agreed to help for 4 lakhs, and a friend promised to send me the money.
However, the friend failed to send the money, so the advocate did not assist me.
Despite these difficulties, I filed the case myself and appeared in court in person without an advocate.
While doing this, I faced serious health issues and was hospitalized with high blood pressure due to stress and personal problems.
At the same time, an Australian citizen interfered with my religious practices by stopping temple pujas, which added to my mental and emotional stress.
Additionally, money was stolen from my bank account without OTP authorization, leaving me financially vulnerable.
To proceed with the case, I had to borrow money from friends as a loan.
 
Unfair Dismissal of My Case:
On May 5, 2025, the Sri Lankan Supreme Court dismissed my fundamental rights case SC/FRA/87/2025, claiming it was filed late.
Even after knowing my hospitalization, legal struggles, financial exploitation, and religious interference, the court ignored these facts and denied justice.

 
Violations of International Law:
Article 25 of the UN International Covenant on Civil and Political Rights (ICCPR) guarantees the right to participate in public affairs and political processes.
The Election Commission’s 14-day limit violated this right.
The court’s refusal to consider my valid reasons also violated international democratic standards, including the Canadian Quebec political rights guidelines.
Despite clear proof of fundamental rights violations, not even a single rupee of compensation has been paid to me.
 
My Demands:
Reconsideration of my case SC/FRA/87/2025
Accountability for the Election Commission’s unfair 14-day deadline
Compensation for the damages and rights violations I suffered
Stronger protections for citizens facing medical and financial difficulties during legal proceedings
 
Why This Matters:
Justice should not depend on wealth or privilege
Health, financial hardship, and religious freedom must be respected in legal systems
The international community must protect political and civil rights for all individuals

நான், சத்தியந்திரா தியாகராஜா, என் வழக்கு SC/FRA/87/2025 குறித்து உலக மக்களிடமிருந்து ஆதரவை நாடுகிறேன்.
இந்த வழக்கில் என் அடிப்படை உரிமைகள், அரசியல் பங்கேற்பு உரிமைகள், நிதி உரிமைகள் ஆகியவை மீறப்பட்டுள்ளன.
இன்று வரை எந்தவித இழப்பீடும் வழங்கப்படவில்லை.

 
சம்பவ விவரம்:
2025-ல், இலங்கை தேர்தல் ஆணையம் அரசியல் கட்சி பதிவு செய்ய அறிவித்தது.
ஆனால் அவர்கள் மட்டும் 14 நாட்கள் பதிவு செய்ய நேரம் அளித்தனர்.
இந்த குறுகிய காலம் சிறு கட்சிகளுக்கு மிகப்பெரிய பாதிப்பை ஏற்படுத்தியது.

அந்த நேரத்தில்:

வழக்கு தொடர வழக்கறிஞர்களைத் தேடியபோது, 25 இலட்சம் ரூபாய் கேட்கப்பட்டன.
பிறகு 4 இலட்சம் கேட்டு ஒருவர் ஒப்புக்கொண்டார், நண்பர் ஒருவர் பணம் அனுப்புவதாக கூறினார்.
ஆனால் அந்த நண்பர் பணம் அனுப்பவில்லை, அதனால் வழக்கறிஞர் உதவியளிக்கவில்லை.
இந்த சிக்கல்களையும் சமாளித்து, நான் நேரடியாக உச்ச நீதிமன்றத்தில் வெளிப்படையாக வழக்கு தாக்கல் செய்தேன், வழக்கறிஞர் இல்லாமல்.
அதற்கிடையில், அதிக இரத்த அழுத்தத்தால் மருத்துவமனையில் அனுமதிக்கப்பட்டேன்.
மேலும், ஒரு ஆஸ்திரேலிய குடியுரிமையாளர் என்னுடைய கோவில் பூஜைகளை நிறுத்தினார், இது மனச்சோர்வுக்கு காரணமாக இருந்தது.
கூடவே, என் வங்கிக் கணக்கில் இருந்து OTP இல்லாமல் பணம் திருடப்பட்டது.
நான் நடந்து கொண்ட வழக்குக்காக நண்பர்களிடம் கடனாக பணம் வாங்கினேன்.

මම සත්‍යින්තිරා තියාගරාජා, මගේ නඩුපත්‍රය SC/FRA/87/2025 සම්බන්ධයෙන් ජාත්‍යන්තර සහාය ඉල්ලමි.
මෙම නඩුව තුළ මගේ මූලික, දේශපාලන හා මූල්‍යමය අයිතිවාසිකම් උල්ලංඝනය වී ඇත.
අද දක්වා කිසිදු වන්දියක් නොලැබී ඇත.

 
සිදුවීමේ විස්තරය:
2025 දී, ශ්‍රී ලංකා මැතිවරණ කොමිසම පක්ෂ ලියාපදිංචියට 14 දිනයක් පමණක් ලබාදුන්නා.
මෙය සාධාරණ නොවූ අතර කුඩා පක්ෂ සඳහා අසාධාරණ විය.

එම කාලයේදී:

මම නඩු ගොනු කිරීමට නීතීඥයන් සෙවූ අතර, රු. 25 ලක්ෂයක් ඉල්ලා තිබුණි.
පසුව රු. 4 ලක්ෂයකට නීතීඥයෙකු සොයාගත්තා. මිතුරෙකු මුදල් මාරු කිරීමට සහතික විය.
එහෙත් එම මිතුරා මුදල් යැවීම අසාර්ථක වීමෙන්, නීතීඥයා උදව් කළේ නැහැ.
එවැනි අපහසුතා අතරතුර, මමම නඩුව ස්වයං නඩුබාරගනිමින්, නීතීඥයකු නොමැතිව ශ්‍රේෂ්ඨාධිකරණයට පැමිණියා.
එම අවස්ථාවේ, ඉහළ රුධිර පීඩනයක් සහිතව රෝහලට ඇතුළත් විය.
අමතරව, ඇස්ට්‍රේලියානු පුරවැසියෙකු මගේ පූජා විරහිත කළේය, මනෝ ආතතිය වැඩි විය.
මගේ බැංකු ගිණුමෙන් OTP නැතිව මුදල් සොරකිණි.
නඩුවට මුදල් සපයන ලෙස මිතුරන්ගෙන් ණය ලබා ගත්තා.
