Justice For Kenya Swimming Federation!
The Issue
Kenya Swimming Federation (KSF) was suspended in December 2019 by World Aquatics and is currently threatened by a Complete Ban set to take effect on 15th of July 2023, as a result of not holding elections since September 2014. The swimmers, technical referees, and coaches will be completely excluded from attending all international swimming meets including the Olympics, World Senior and Junior championships, Regional CANA zone championships and the commonwealth games.
On the 8th of July 2023, elections took place as per the road map that had been issued by the World Aquatics Stabilization Committee and nominees by virtue of being unopposed should have been declared as the new governing executive board of the Kenya Aquatic Federation. Regrettably, the Returning Officer of the elections, Centre For Corporate Governance, was absent due to alleged intimidation and coercion and therefore the unopposed nominees were not declared elected.
At the moment there is an injunction in court (as a result of a petition E088 filed 18th March 2021) that stops the Kenya Swimming Federation or any agent acting on its behalf from conducting elections. World Aquatics is not an agent or a body acting on behalf of Kenya Aquatics or the Swimming Federation. Its mandate is to ensure that its member bodies are run transparently, and according to their constitution and by laws.
It is therefore unfortunate that local laws and orders are being used to interfere with the functions and mandate of an international sports organization.
This petition therefore demands:
1. The Cabinet Secretary Ministry of Sports, Culture and Heritage to support the process of helping Kenya swimming avoid a ban through the elected office and not through the formation of a normalization committee/IMC (Interim Committee).
2. That the Returning Officer, The Centre For Corporate Governance, immediately proceed to confirm and ratify the unopposed officials elected on 8th July 2023, as the duly elected officials and office bearers.
