Justice for Jerlon Morgan: Review an Oklahoma Life Sentence Based on Recanted Testimony

The Issue

Jerlon Morgan is serving a life sentence in Oklahoma after testimony used against him was later recanted. His family believes his conviction deserves a fair review. We are asking Oklahoma officials to take a closer look at the evidence in his case. 

The Story

Jerlon Morgan has spent more than a decade in prison serving a life sentence in Tulsa County, Oklahoma, for a crime he has long maintained he did not commit.

His conviction raises serious concerns because the case against him centered on an alleged statement attributed to him by a witness, Jarred Miller. According to the record described in this petition, that statement was never recorded, was allegedly made “off the record,” and was not supported by physical evidence directly tying Jerlon Morgan to the killing.

At the scene, eyewitnesses Jarred Miller and Joseph Thomas initially gave statements that did not include Jerlon Morgan. Within 24 hours, both changed their statements and placed him at the scene. Investigators later claimed that after the second statement was taken, Jarred Miller said Jerlon told the co-defendant to “finish him.” However, Joseph Thomas, who was reportedly standing only feet away, said he never heard Jerlon Morgan make that statement.

That alleged “off-record” statement became the central evidence used against Jerlon Morgan at trial.

Then in April 2021, Jarred Miller signed an affidavit recanting that statement and saying he had lied when he told investigators that Jerlon said “finish him.” Even with that recantation, Jerlon’s post-conviction relief application was denied without a hearing.


This is why Jerlon Morgan’s case deserves renewed public attention and meaningful review.

 

Why This Case Deserves Review


This petition is not asking anyone to ignore the tragic loss of Marcus Lewis. His death matters. Justice for victims matters. But justice also requires confidence that the right person was convicted based on reliable evidence.

Jerlon Morgan’s case raises serious questions:

    •    The most damaging statement attributed to Jerlon was allegedly made off the record.

    •    That statement was later recanted by the witness who claimed Jerlon said it.

    •    Another witness present said he did not hear Jerlon make that statement.

    •    The witness whose statement was used against Jerlon gave multiple inconsistent versions.

    •    Jerlon’s request for post-conviction relief was denied without a hearing, even after the recanting affidavit.

When a life sentence is tied so closely to testimony that has later been withdrawn, the public should not look away. A case like this deserves careful review, transparency, and accountability.

The Human Cost

Jerlon Morgan is more than an inmate number or case file. He is a father, a son, a husband, and a loved one whose family has spent years fighting to be heard. His daughters have grown up without their father in their daily lives. His family has carried the emotional burden of this conviction for years while continuing to seek answers, fairness, and justice.

We are calling on Oklahoma officials to give Jerlon Morgan’s case the fair and serious review it deserves.

    •    Meaningful consideration of whether Jerlon Morgan received a fair process

    •    Renewed public and legal attention to the facts of this case

A life sentence should never rest on unreliable, inconsistent, and later-recanted testimony without that evidence being closely re-examined.
