Justice for Bernedine, Ja’Leah, and Jaxton — Our Community Calls for Full Accountability
The Issue
Our community is grieving the tragic and preventable loss of 32‑year‑old Bernedine Spann, her 13‑year‑old daughter Ja’Leah, and 7‑year‑old son Jaxton, who were killed in a devastating wrong‑way crash on U.S. Highway 82 in Leesburg, Georgia. According to publicly available reports, their vehicle was struck head‑on by a driver who was allegedly traveling the wrong way on the highway and was suspected of being under the influence at the time of the collision. [yahoo.com], [wsbtv.com] [GoFundMe]
Bernedine and Ja’Leah died at the scene.
Jaxton fought for several days before passing away in his father’s arms.
This tragedy did not occur because of weather, mechanical failure, or unavoidable circumstances. According to investigators, it resulted from dangerous and preventable decisions that led to a family being destroyed in an instant. Formal charges have since been filed in connection with the collision, and the case is moving forward in the Georgia court system. [usmagazine.com]
Bernedine leaves behind another son who was not in the vehicle , a child now forced to navigate life after losing his mother, brother, and sister all at once.
📌 WHY WE ARE PETITIONING
As this case proceeds, we are calling upon our justice system to uphold full transparency, fairness, and accountability. Too many lives in our communities have been lost due to impaired and dangerous driving. Far too many repeat DUI offenses occur because current systems often fail to prevent high‑risk drivers from reoffending. We believe meaningful change is overdue — and it needs to start here, with a clear call for stronger accountability, safer roads, and justice that reflects the value of every life affected. We stand united as a community in asking that the legal outcome reflects the magnitude of this tragedy.
Specifically, we respectfully ask for the following:
1. Accountability for EACH life lost
Three innocent lives were taken. We ask that each life be recognized individually and that accountability reflects the full extent of the harm done.
2. No lenient plea agreements
We request that no plea deal be accepted that minimizes this tragedy, reduces charges in ways that diminish the value of these lives, or allows for an outcome that does not reflect the seriousness of what happened.
3. Sentencing that honors the loss of all three victims
If the case proceeds to sentencing, we ask that the court consider consecutive penalties where appropriate, recognizing that one sentence cannot fully represent the loss of three beloved family members.
4. A transparent and thorough legal process
We ask that the proceedings remain open, diligent, and handled with integrity, and that the victims’ family is fully included under Georgia’s Crime Victims’ Bill of Rights.
5. Respect for the family’s right to be heard
This family deserves to have their voices and concerns honored at every stage.
📌 WHAT HAPPENED
According to the Georgia State Patrol and multiple news outlets, the crash occurred when a vehicle traveling the wrong direction collided head-on with the Spann family’s Honda Accord on January 14, 2026. [yahoo.com], [wsbtv.com]
Investigators reported that the driver was suspected of driving under the influence at the time. Both the suspected driver and a passenger in her vehicle were transported to the hospital after the crash.
Subsequent reporting confirms that the driver was later arrested and charged with multiple offenses, including 3 counts of first‑degree homicide by vehicle, DUI, wrong side of the roadway, and endangering a child, among others. [usmagazine.com].
Walb News reported that the driver is currently out on bond. [Walb.com].
These facts are publicly documented and form the basis of this petition.
📌 A CALL TO OUR COMMUNITY
Randolph County Schools has publicly mourned the loss of Ja’Leah and Jaxton, describing them as children who brought light, warmth, joy, and kindness to their school communities.
Friends, coworkers, neighbors, and the community have expressed heartbreak and anger, calling this tragedy senseless and preventable. Source: Facebook.
After speaking with the father, we learned the surviving father is now facing unimaginable decisions as he tries to rebuild his life. When he received the devastating phone call about the crash, he was working a demanding career maintaining power plants across different locations. Overnight, everything changed. He has had to step away from his job on the road in order to care for his surviving son, navigate overwhelming grief, and protect both of their mental and emotional well‑being. Now he is trying to figure out what comes next , what work he can do, what opportunities remain, and how he can provide stability for his family while carrying the weight of this tragedy. A family of five is now a family of two.
This petition is our collective voice… peaceful, respectful, and rooted in love.
We gather not to interfere with the legal process, but to support it by ensuring these three lives are not forgotten.
📌 A CALL TO THE MEDIA
We welcome responsible media coverage that highlights:
the family’s unimaginable loss
the community’s united call for justice
the importance of safe and accountable legal outcomes
the broader need to prevent impaired and reckless driving
We seek not sensationalism, but awareness, compassion, and transparency.
