Demand Justice for Charlie
The Issue

On August 22, 2019, my daughter Charlie sustained catastrophic abusive head trauma leading to bilateral bleeding in her brain, multiple broken and fractured ribs, bleeding in all three layers of both retinas, a neck and spinal injury, as well as other internal and external injuries.
Charlie was left in the care of Destiny Myers, my fiancé's sister, for over 6 hours that day. Dylan Myers, my fiancé, has been charged and convicted of F1 neglect of a dependent resulting in catastrophic injuries. He was also charged and found not guilty of F3 battery and F3 aggravated battery.
The jury found him innocent of Charlie's injuries. Destiny Myers was the only other adult left alone for any amount of time with Charlie. Destiny needs to be tried in relation to Charlie's injuries. This was not an accident, and the person responsible for her catastrophic injuries is still free today.
Comparing Destiny’s initial statement and Dylan’s initial statement to law enforcement, they both report the following timeline:
Karen Crispin arrived around 6:55pm. She walked back out to her truck to grab the thermometer Destiny Myers called her for. She held the front door open for Dylan Myers, who was already on the phone on Facetime with Dixie Cordray (Mason) and their daughter Arista, when she walked back in as they walked in together. Karen was holding Charlie for 10-15 minutes, she put her in the swing, Destiny then stated she asked Dylan to take Charlie to bed as she was acting tired. Dylan sat his phone down next to Destiny, took Charlie to the bedroom, changed and swaddled her, then laid her to bed and turned on her white noise. Destiny stated it was about 5 minutes. Dylan stated he put her to bed, walked out, resumed his Facetime. Karen leaves. Almost immediately Dylan says he goes to check on Charlie because she made a weird noise. Destiny reiterates multiple times that Charlie made a strange noise like a puppy getting stepped on ONLY while her, Dylan and Desmond were in the living room. Dylan brought Charlie out to Destiny and asked if she looked weird. Destiny said she looked like she was seizing, she removed her swaddle, and this is when both report that I walk in. Immediately, Dylan and Destiny both told me Charlie was acting strange, Destiny was holding Charlie without touching her, she refused to call 911. I called 911 immediately after Destiny refused. EMS showed up very quickly.

Destiny took this picture of Charlie and Desmond laying together at 6:09pm. Compare how Charlie is laying in this photo to how Charlie is laying after she has been put into a medical coma. Charlie also has a bruise forming on the left side of her head (right side in this picture). This was taken at 6:09pm, an hour before anyone else arrived to the apartment.
Destiny’s statement also touches briefly on Charlie presenting as pale, breathing strangely, and making strange noises, all things Dr. Roberta Hibbard, child abuse specialist, testified Charlie would have presented at the time of her injuries. This is roughly 40 minutes before Dylan or his mother arrived at my apartment. This is roughly 60 minutes before I got home from work.

Destiny falsely testified to the amount of time that Dylan was alone with Charlie, as well as placed him in and out of the bedroom more times than he was. She lied on stand.

Destiny texted Dylan on Aug 24th and asked him, out of nowhere, when she should expect to be in jail. This is right before she decided to blame me. Then, after a 5 hour interview with Chief of Police Aaron Mattingly, Destiny changes her story yet again to that of Dylan being the perpetrator, which did not hold up to a jury.
This is the woman who the Crawfordsville Police Department and the Prosecutor, Joseph Buser, decided to protect even with Dylan being found NOT GUILTY of abusing Charlie Marshall.

April of 2019, Det. Long, the lead detective into Charlie's injuries, was sued by a woman who claimed he was reluctant to open a case or investigate it properly. He discouraged this woman from filing her report and was reluctant to conduct a thorough investigation. This is exactly how he also handled this case. He let Sara Baumann of DCS step in and let her take over his investigation. Then Det. Long and the prosecutor, Joseph Buser, used this negligent investigation for the basis of a malicious prosecution pushed by Nathan White, Charlie's father.

This case should have never been filed. Destiny Myers should have been charged. Please help us get justice for my baby. Please help us get this child abuser held accountable. Please sign and help us end this 3 year long nightmare and get justice, once and for all, for Charlie Renee Marshall!
