La causa

On 9 June 2026, the French Collège de déontologie des magistrats de l'ordre judiciaire (CDJ) issued Opinion 2026–27, clarifying the ethical boundaries of judges' membership in private associations, including irregular fraternities.

The opinion rejects a blanket prohibition and instead advances a principled, appearance-based test that prioritizes objective impartiality and procedural safeguards over formal neutrality toward associative life.

Grounded in Article 6 of the European Convention on Human Rights, the opinion aligns with a broader jurisprudential trend treating impartiality—especially its objective dimensions—as essential to a fair trial.

Consistent with European and domestic case law, it holds that disqualification may be warranted whenever circumstances would lead to a reasonable, fully informed observer to entertain legitimate doubts about a judge's neutrality, even absent proof of actual bias.

The decisive inquiry is whether a judge's private commitment could plausibly be understood as creating a priority allegiance or selective solidarity incompatible with the judicial duties of independence and neutrality.

How could such irregular secrecy have remained so close to democratic transparency for over 150 years without such recent notice?
