After my CIC vote, picture day happened Superintendent Fran Marek said that if Habib wants to be in the yearbook he must be in code to participate in school activities during school hours; went to a few football games and driving during drop off I saw so many boys with long hair. I spoke with a Civil Rights for Education lawyer, and I explained to him how the older (middle/high school) were allowed to have “out of code” hair and still be participating in school activities, and even had their pictures taken for the yearbook; how my proposal for change was denied and killed at CIC level, and how my options have been exhausted. He adviced me and asked if I had filed a grievance, (which the district never said that was an option, and that my options were done); He walked me through the process and I filed the grievance, which was a quick turnaround and had a meeting was set quick. Between this time and the meeting my son was humiliated and bullied by a substitute who wanted to infringe her beliefs on a class full of 4th graders. She calls Habib to her desk and joked with him why he’s there. And then sarcastically says oh what gorgeous hair you have and what a beautiful girl you are. He goes I’m a boy. And then goes well I don’t think boys should have long hair. The whole class stood up for him, one mentioning how she wears boys clothes but doesn’t make her a boy, and another pointed that she (the sub) had short hair which she clearly said earlier is made for boys. And then says she was not there to argue with them and that she doesn’t agree boys should have long hair back in her day boys didn’t have long hair. When I asked the kids to describe since no one knew her name as she goes by Mrs. B. they said she has big holes in her ears, very short hair, and tattoos all up her legs, and that it looks like she wore an underwear and shirt to school; and yet this way “out of code” was allowed to teach our children numerous times. When I filed the complaint against her I asked that she apologize to him and I wanted to be there, they ignored me numerous time. My son nor I received an apology. Which I believe he is owed one—we teach our kids to be nice and not to say nothing if it is not nice. And when and if they are mean they apologize. I took my legal counsel with me and the assistant superintendent and the district lawyer. We had mentioned all the above and they could not address the substitute issue because it was not in the original grievance and that we would need to file a separate grievance if we wanted. Later that day my lawyer calls and said the substitute can not apologize because she is no longer employed by the district. We asked for the code to change or if that cannot be done we asked for a waiver till his hair is at 12” length. BOTH WERE DENIED and we are currently in the APPEALS process. This week over 100 boys in the high school alone were pulled out of class because of their hair length, some went voluntarily to the COSMETOLOGY department and had it trimmed, some refused and went to ISS, and some called their parents and went home. We stopped education and valuable time throughout the week. Appeals process is now having to be presented to the board for a vote. Which in contrary of what I was told since day one cant happen since my proposal was denied at my campus. This time we noted that Fran Marek is the one designated to be addressing these issues and has failed to do so during the whole process, and sending everything for her assistant to do; which is not his specialty as it’s set in their handbook. Will post date of when it goes to the Board for those that would like to attend.
