What does a settlement on Enbridge debacle in Kalamazoo have to do with Line 3 in MN?!

Unlike conventional oil spills, tar sands oil SINKS into the sediment of rivers and lakes. Does it make ANY sense for the Department of Justice to condone a NEW tar sands pipeline in a MORE pristine and water rich environment --while at the same time supposedly penalizing the same company for the largest inland tar sands oil spill in US history?
