Amend GBL 89-cc to reflect current practices
The Issue
Process servers whom submit all of the information required in GBL 89-cc electronically to an independent 3rd party are forced to then hand write the same information into a log book due to the NYC DCA interpretation of the aforementioned rule. For these process servers, the written log book is clearly redundant and unnecessary. In addition, the DCA has proceeded to impose outrageous fines for clerical errors in the hand written log book, and in the process, force many honest and hardworking people out of the industry. Amend GBL 89-cc to provide the process server with the option to obtain a copy of their log records from the independent 3rd party provider in lieu of a hand written log book. The amendment would rectify the issue and process servers can get back to focusing on serving the legal community.
