Dear Supporters,
By way of simplicity, I copy the statement I wrote for a hearing in the Criminal Court of Appeal on Tuesday:
WITNESS STATEMENT
BACKGROUND
1. I am Sabine Kurjo McNeill of 21a Goldhurst Terrace, London NW6 3HB, web publisher and co-founder of the Association of McKenzie Friends. I got to know the Appellant at a meeting that I had organised at the House of Lords in March 2010, not long after he had spent several months in Caswell Clinic, the mental hospital whose Director was Dr Tegwyn Williams then. 2. Later that year I visited him in Brittany and became his web publisher and McKenzie Friend, acting in a variety of capacities from sending emails because his were blocked to visiting him in prison. 3. I am writing this Witness Statement after his sister Mrs Celia Jeune sent me the attached Application for Adjournment. She had typed it from her brother’s handwriting which is very difficult to decipher due to his arthritis. He will be 70 on 12 March this year.
4. This is to put on record that the Appellant has been dealing with an extreme case of exceptional legal bullying and harassment by imprisonment as a consequence of his civil case against South Wales Police that has been ongoing since some 20 years.
5. This case is based on South Wales Police having repainted a machine gun that was part of one of the historic planes that the Appellant owned when he was practising as a veterinary surgeon. However, South Wales Police fabricated the Appellant to be struck off the professional register in 2002, depriving him not only of income but also replacing his professional life with one of a Litigant in Person. His records of winning appeals was most impressive.
6. In particular, South Wales Police have used that false medical diagnosis, which is the substance of the cases listed for 10th February. Abuse of process in courts, torturous conditions in prisons and by GeoAmy staff besides medical negligence have imposed impossible conditions on a Litigant in Person to conduct his case. This includes seven non-productions by prisons to courts.
7. His inability to get access to telephone and thus legal representation, money for stamps, his legal documents a lot of which were stolen, besides his laptop ordered by HHJ Seys Llewellyn, amount to violations of human rights articles of the highest order as the basis for claims against HMP Cardiff, HMP Swansea and GeoAmy.
8. His most recent supposed ‘refusal’ of a visit by McKenzie Friends is only a small sample of grotesque mistreatment that only this man could have endured: in Caswell Clinic he was attested to belong to the top 3% of the IQ in this country’s population.
9. His successful solo flight to Australia in a wartime plane is a live demonstration of his tenacity, stamina and capacity for perseverance. He should be celebrated as a national hero rather than persecuted, harassed and bullied in ways which no normal human being could dream up.
DR TEGWYN WILLIAM’S FALSE DIAGNOSIS ON BEHALF OF SOUTH WALES POLICE
10. As I helped the Appellant to put summaries and court submissions together, I also have a record of the statement in which Dr Williams claimed that the Appellant has serious brain damage, possibly cancer. I believe that was meant to explain his diagnosis of ‘delusional paranoid personality disorder’. This has been used only recently in some record to justify the extremely inhuman and unlawful treatment of the Appellant. It has to be noted that he had been commissioned by South Wales Police to make an assessment which I believe he actually wasn’t qualified to make.
11. Most incorrectly, this diagnosis had prevented the Appellant from getting a hip replacement in this country. Eventually this operation was carried out in France.
12. An attestation by the Civil Aviation Authority makes it clear that the diagnosis was fabricated for the purposes of South Wales Police who continue to prefer to commit crimes to cover up crimes rather than apologise and compensate.
CURRENT INCARCERACTION AND PRISON CONDITIONS
13. The inability to access documents, to type, print and make photocopies and the uncertainty of knowing whether mail gets sent, delivered and received make it impossible to conduct legal proceedings from within prison.
14. Seven times the Appellant has not been produced in court and the general excuse given is that he supposedly refused himself.
15. The Appellant suffers from serious gut pain but he is refused even pain killers, let alone appropriate examinations for treatment.
16. His arthritic condition requires him to be in a wheelchair which has been supplied by supporters, but prison staff claim he doesn’t need it.
This is therefore to support the Appellant’s application for Adjournment with a view to restoring his health and working conditions such that he can at least put the index of documents together for this application.
This is also a request for appreciation of the mental powers necessary to put the index together, given the conditions described above.
We hope that he will come out ALIVE on 7 March, ready to celebrate his 70th birthday on 12 March!
