There has been a recent exchange of letters between Tarion President Howard Bogach and HVAC expert Dara Bowser related to this petition. From Mr. Bogach's letter, it appears that Tarion is saying that these systems comply with the Ontario Building Code and, therefore, there is no reason for an Inquiry. Yet, here is a quote from a Licence Appeal Tribunal (LAT) Decision in which the homeowner won against Tarion: "There is no doubt that there is a significant problem with the Applicant’s HVAC system. Tarion admits that. The Added Party’s expert witness admits that. The evidence makes that clear. It does not comply with the Ontario Building Code because the system does not heat the premises to 22 degrees Celsius in the winter because the heating output is insufficient. The Applicant has had to endure that problem for four winters. Both the expert for the Applicant and for the Added Party agree. That is intolerable." (By the way, Dara Bowser was the Applicant's expert in this LAT hearing.) In his letter, Dara Bowser offered to share his calculations, testing results, etc. with Tarion that found these systems don't meet the Ontario Building Code. In turn, Dara has asked that Mr. Bogach provide him with information to support how Tarion has reached its conclusions, including any testing, design reviews, etc. Obviously, it is very important for Minister McMeekin to move forward with this Inquiry. Do you know of another person or two who would be willing to sign this petition? If you do, please ask them to do so. We need to let Minister McMeekin know that this Inquiry is important to Ontarians.
