There is an epilogue to this story! Your neighbor decided to appeal the local board's decision by submitting a "petition for intervening remonstrator status." This is an extremely difficult test to pass, as the hearing judge noted in his March 23rd decision: ". . any one of the factors the Remonstrator has cited may not be enough to grant the Remonstrator Invervening status, however, in this case, the synergistic effect of the many factors is enough to declare that (the neighbor) does have an interest in whether or not the Applicant receives its' permit." In May, we were notified that a hearing date had been set for July 7th. On July 7th, each party was able to submit additional evidence and cross examine each other. The hearing judge also asked clarifying questions. A Circle K representative testified that sales had been brisk and they were eager to expand their display. On August 30th, the hearing judge completed his facts and findings and conclusion of law wherein he DENIED Circle K's transfer of permit. Circle K made a choice to not file any objections and on September 20th, the Alcohol and Tobacco Commission voted to deny the transfer. What does this mean? Circle K will resume their sales at the Smith Valley/135 location. What won the case? "In this case, though, the Intervening Remonstrator has presented a large number of actual (door-to-door) signatures of residents in very close proximity to the Appplicant, gathered in an extremely orderly, verifiable manner, which illustrate the lack of desire for these services in the community." THANK YOU to those that opened their door, listened to what Indiana law considers in alcohol permitting, and answered the question, "Do you desire to purchase alcohol at this location.?" It is YOUR collective voice that was heard and stood strong through this year long process.
