Improve HOA oversight and accountability
The Issue
For years, I have been a homeowner within a community governed by a Homeowners Association (HOA). Like many others, I believed that HOAs were designed to maintain property values, ensure community standards, and protect the interests of the community. However, my experience has taught me that the lack of oversight and accountability in these organizations can lead to significant issues for homeowners.
State laws in many regions offer nearly zero protection for homeowners against the arbitrary decisions and actions of HOAs. Without appropriate checks and balances, HOAs can impose unreasonable fines, alter community rules without proper consultation, and even engage in financial mismanagement. This lack of regulation not only affects homeowners' finances but also their peace of mind, as they have little or no recourse to protect themselves against unfair practices.
According to the Community Associations Institute, there are more than 355,000 HOAs in the United States, governing over 26 million homes. Yet, despite these staggering numbers, there is no federal oversight, and state laws vary significantly, often providing inadequate or no protections for homeowners. It's crucial that homeowners in Pennsylvania, and across the country, are granted rights and protections that ensure fair and transparent governance of these associations.
I am calling for legislative changes at the state level to increase oversight and accountability of HOAs. This includes mandatory training, audits, transparent election processes, and the establishment of a regulatory body to handle disputes, protect homeowners rights, and make HOAs Board of Directors and/or HOAs representatives (i.e. Property Management Companies) accountable for violations of state/county statutes. Additionally, standardize clear rules should be set across the state for permissible actions and fines, ensuring that homeowners are fully informed of their rights.
Homeowners deserve better protection and transparency from their HOAs and/or HOA managing contractors to prevent abuse of power. By supporting our petition, you will be advocating for laws that provide security and justice for countless homeowners who, like myself, believe in the dream of community living but are disillusioned by the current system.
