In February 2016, Capilano Honey Limited, a public company listed on the ASX, instituted proceedings in the Supreme Court of New South Wales against Simon Mulvany, a Victorian beekeeper and “savethebees” blogger. Ben McKee, who is the chief executive officer of Capilano sues Simon for defamation. Capilano, the public company,sues him for injurious falsehood and misleading or deceptive conduct. According to Simon, consumers are becoming more aware of the health risks and environmental damage caused by chemical-laden foods and place a premium on foods that are free of contaminants or artificial chemicals. This in turn leads to Australian consumers preferring food produced locally or at least in Australia over that produced in some other countries. Similarly, food manufacturers such as Capilano try to capitalise on these consumer preferences and use terms such as “Australian” “Organic” “Pure,” “100% Pure,” “Pure and natural honey”, “Australian since 1953” and “100% pure Australian honey”. Whether Capilano’s honey can fairly be so described is highly relevant to this litigation. Simon is currently restrained from being able to participate openly in this legitimate public discussion or to say much more about Capilano and Ben McKee than is set out here. This may change as the Supreme Court is currently reviewing the nature of the restraints Simon is under whilst these proceedings are in progress. In May 2017, Simon was ordered to take down his earlier crowd funding platforms which raised around $23,000 and enabled him to defend himself up to then with his first legal team. Today, 7 August 2017, eighteen months after first being sued and with a robust legal team coalescing around him, Simon asks for your further support by donating to help with the costs of defending himself and pay for: 1. Comprehensive testing of the safety, composition, authenticity, origin, traceability and purity of Capilanofood products including; a. Authenticity; b. Antibiotic residues; c. Bee treatments and pesticides; d. Bee repellents and fumigants; e. GMO and further residues; f. Microbiology (E.coli ,AFB etc..) 2. Expert legal team including senior and junior solicitors and paralegals, junior counsel and eminent senior counsel; and 3. Travelling and related costs for Simon to instruct his legal team and stand before the Court (including administration costs). If Simon raises more than needed, he will donate the remainder to Discoverme software company to continue to develop and market the global honeymap(app), AHBIC for their relentless campaign to ban imported honey in Australia and some inspiring women who have been giving up their time freely to educate children around Australia at schools and kindergartens about the importance of bees.
