Application filed 4 inquiry was numbered as MA1831/20 ,and was placed b4 Hnble Justice,R.Nariman, N.Sinha & K. Joseph on 2.12.20. But b4 Applicant argued, Hnble Justice R.Nariman said that since the same subject has been repeatedly agitated which is abuse of process of court and therefore the MA was dismissed by imposing 1 lac costs. Applicant repeatedly submitted that despite repeated applications earlier, the order on basis of fraud with fictitious documents continues to survive.The truth and fraud in the matter was never heard & acted upon.However Hnble judges did not hear anything further.Even the Advocate for Auction Purchasers Mr Katneshwarkar was not allowed to argue.

if the allegation of fraud alleged earlier was heard and acted upon, as per precedents/established principles on fraud then  the order would have been recalled and would not be surviving.Survival of an order on basis of fraud/fictious documents is blot on justice.

Truth is being supressed brutally to favor the respondent Bank cheat Poor lawabiding #MSME OF 123mnts legitimate charges as ascertained by an award @MSMEDAct 2006 & upheld by all lower courts.
