Subject: Request for Review and Reconsideration of Closed Complaint File No. 20-01433 and New Complaint Regarding Administrative Unfairness by the Village of Standard
Dear Alberta Ombudsman,
I am writing to formally request a review and reconsideration of the decision to close my complaint under File No. 20-01433, which was closed on June 17, 2023. I believe the closure was based on a fundamental misunderstanding of the issues presented and insufficient investigation into the serious allegations against the Village of Standard, which continue to cause significant hardship. I also wish to file a fresh complaint based on the ongoing administrative overreach and resulting "living crisis" caused by the Village.
I. Grounds for Reconsideration of File No. 20-01433
My initial complaint (File No. 20-01433) was strongly encouraged by the Alberta Court Legal Support program on June 30, 2020. I was advised to directly engage with Municipal Specialist Commissioner Ms. Marianne Ryan due to the complexity and severity of the issues.
The stated reason for the closure of my complaint on June 17, 2023, was that "since Mr. Pan already paid his property tax, case is closed." This decision, reached despite communications from my eldest daughter and I both to the investigator, manager, and Deputy Ombudsman, fundamentally misunderstood and ignored the core of my complaint.
The payment of my 2020 annual property tax was never the sole or primary issue, which was normal annual property tax payment that I always do; I sent this copy to your Ombudsman just for the proof that I paid my property tax as usual. The Ombudsman's investigation failed to address, or seemingly even acknowledge, my allegations regarding:
· Illegal charges for "mobile home of stage costs." This was a key component of my original complaint that was incorrectly subsumed under a general property tax issue.
· The illegal auctioning of my hotel property. This is an extremely serious action taken by a municipal body, which appears to have been entirely overlooked or dismissed without proper investigation.
The closure of my file based solely on a single property tax payment, when more egregious claims of illegal charges and property seizure/auction remained uninvestigated, constitutes administrative unfairness and a flawed decision. This oversight has emboldened the Village of Standard to continue its alleged administrative overreach.
II. Ongoing Complaint Regarding the Village of Standard
The administrative unfairness and alleged abuses of authority by the Village of Standard have persisted since 2020 (the approximate start of these issues) and have escalated into a "living crisis" for myself. I own both a hotel and a residential property in the Village of Standard, both of which are currently inaccessible due to the Village's actions.
The specific actions/inactions by the Village of Standard include, but are not limited to:
· Instituting unwarranted and illegal charges related to "mobile home of stage costs."
· Proceeding with the illegal auction of my hotel property.
· This has forced my emergency relocation to a senior's residence in Calgary, creating immense personal and financial strain.
· After I was relocated to the senior house in Calgary, my properties are now "locked out" by Nov. 13, 2025 preventing me from residing there or accessing essential belongings.
· The Village has reportedly engaged in an "illegal snow dumping" invoice, which I believe is another instance of unfair charges.
· My realtor and liquidator both unable to continually sell my properties and movable assets.
The direct consequences of these actions have been severe:
· I have been forcibly displaced from my home and business.
· I am unable to retrieve important documents and belongings from my properties.
· My mental and physical health has significantly deteriorated; I am currently undergoing mental health treatment for major depression, heavily exacerbated by these ongoing issues.
· My ability to conduct my business (as both properties are under my company, of which I am the sole owner) has been severely impacted, leading to loss of income and business continuity.
I have made repeated attempts to resolve these issues directly with the Village of Standard, including sending multiple letters to their office and hiring legal counsel until I could no longer afford the mounting costs. I have also pursued remedies through the Alberta Court of King's Bench and Court of Appeal, but these avenues have been financially and emotionally exhausting, particularly as my properties and business remain unreachable.
III. Desired Outcome
I am requesting that the Alberta Ombudsman:
1. Reopen File No. 20-01433 and conduct a thorough, impartial investigation into the full scope of my original and ongoing complaints, particularly regarding the illegal "mobile home of stage costs" and the alleged illegal auctioning of my hotel property.
2. Investigate the administrative unfairness and abuse of authority by the Village of Standard that has led to my properties being locked out and the resulting "living crisis."
3. Compel the Village of Standard to allow me access to my properties.
4. Allow for the deduction of the "illegal snow dumping" invoice from my property tax account.
5. Facilitate the sale of my properties and movable assets by allowing my realtor and liquidator unimpeded access and cooperation from the Village.
6. Provide recommendations for appropriate redress and/or compensation for the significant financial losses, forced relocation, and emotional distress I have endured as a direct result of the Village's actions and the Ombudsman's initial flawed review.
The Ombudsman's previous closure, based on the incomplete review of my property tax payment, has effectively left me without recourse and emboldened a public body to continue actions that I believe are beyond their authority and are causing severe detriment. I respectfully urge you to reconsider my case with the seriousness it warrants.
