SUMMARY OF THE PETITION
This Petition concerns a prolonged pattern of unlawful actions, administrative abuse, and bad-faith conduct by the Village of Standard, the Chief Administrative Officer, the administrative staff, and related officials, which have cumulatively caused severe financial loss, operational damage to my business, destruction of my property value, and serious harm to my physical and mental well-being.
Illegal Auction of My Hotel Property in 2020 While I Was Still Living Inside
In 2020, the Village of Standard illegally conducted an auction of my hotel property located at 718 Broadway St., Standard, Alberta, even though I was still physically residing in the property.
Because I was living on-site, the Village could not change the locks at that time, and therefore later fabricated or concealed charges to justify further enforcement.
The Village also wrongfully added “storage fees” for a mobile home that was legally owned by the Village, not by me—yet these charges were illegally added onto my tax account as though they belonged to me.
Hidden and Fake Charges Wrongly Added to My Property Taxes
The Village concealed these fabricated “storage” and other improper charges inside the municipal tax ledger to make it appear I was in arrears.
These charges were never properly invoiced, never disclosed in writing, never broken down, and no statutory notice was properly served as required under Municipal Government Act (MGA) ss. 412–436.
Village Pretended Not to Receive My Invoices and Statements Showing My Taxes Were Paid
I repeatedly sent the Village my updated tax statements and invoices, showing payments into my In-Trust Property Tax Account.
Despite receiving these documents multiple times, the Village ignored or pretended they never received them, continuing to falsely represent that there were arrears.
Unlawful Property Seizure in 2024 When I Was Relocated for Medical Reasons
During my medical crisis involving severe depression and anxiety, caused largely by the Village’s prolonged harassment and administrative abuse, I was emergency relocated into a senior home in Calgary under medical guidance.
The Village took advantage of my vulnerable condition and absence from the property.
Instead of serving proper legal notice under the Municipal Government Act, the Village only stuck a yellow paper on the doors of both properties (hotel and residential).
No breakdown of alleged arrears, no tax arrears certificate, and no lawful Form 7, 8, or 9 notices were provided.
The Village then illegally changed the locks on both 718 and 721 Broadway St., preventing me, my realtor, my liquidator, and my family from retrieving:
all business records
all personal belongings
family winter clothing
my winter tires
all hotel contents and movable assets required for liquidation.
Blocking My Business Operations for Years
The Village repeatedly interfered with my hotel, restaurant, and convenience store operations.
The Chief of Secretary and CAO extended the Arena Food Counter operating season beyond its permitted period, directly creating competition to sabotage my business revenue.
The Village constructed an additional building connected to the arena, and allowed the Deputy Mayor to open and operate a bar lounge, directly diverting customers away from my business.
These acts were deliberate, targeted, and intended to undermine the financial viability of my hotel and store.
Blocking Sale of My Properties and Assets
My realtor, Ms. Debbie Miztner, was prevented from listing and selling the hotel and residence because the Village locked the properties.
My liquidator, Ms. Lisa Bennett, was prevented from entering the property to appraise and liquidate all movable assets.
These actions caused severe financial losses and the collapse of potential sale opportunities.
Cumulative Harm and Abuse of Authority
These actions show a pattern of systematic administrative abuse, misuse of municipal power, and intentional targeting of me, my family, and my business.
The Village’s conduct resulted in:
significant financial losses
loss of business income
loss of sale opportunities
damage to property value
psychological injury, including depression, anxiety, and suicidal episodes
forced relocation away from my own home
complete deprivation of my property and personal belongings.
Relief Requested
I seek orders from the Court to:
a. Set aside and declare void the illegal tax enforcement actions.
b. Order immediate return and access to both properties.
c. Order full accounting of all municipal charges applied to my tax roll.
d. Award compensation for damages, losses, and harm caused.
e. Declare the Village’s actions to be unlawful, procedurally defective, and contrary to the Municipal Government Act and principles of natural justice.
