
Anti-discrimination of Small-town political issues it's very importance to citizens from long history till up to today although we are already living into the 21 century of civilization society fortunately.
Whenever people make complaint about municipality abuse, most of the time you would received a comment such as "we have no authority to control the municipality level..."; by then you might file a complaint to the Ombudsman or Human Rights Commission. Finally whenever you realized that you might need to file to the court for damages, which it's already too later since the administration agencies who needs time for their investigation of your complaint, which it's already out off the limitation of your claim legal period unfortunately.
With a long waiting period, once the administration agencies who received a response by the municipality, in most cases your complaint possibly will dismissed, just because it doesn't matter how smaller of the municipality is, the inspect of administrations, the court will more trust the statements submitted by the municipality even it might lie every thing, since it's represented for municipal government.
That was the issue exactly happened with my case although the municipal of Standard do have the law to follow (Alberta Municipal ACT s610), but they still chosen over used its power to abused me for 5 years long anyway, If I didn't fired my irresponsible lawyer and represented myself, the court might still don't know the fact yet.
Once the AHRC requested the municipality to response with my complaint, to cover its ass, with my lawyer together, the municipality was putting pressure on me, convinced me to take over the unfair settlement with the main condition immediately withdrawn my complaint to the AHRC, otherwise possibly will get a big lawsuit since I published to the issue to the social medias with the municipality...
Whenever I sent back my offer of settlement, the municipality didn't respond, instead I started to receive all kind of public inspectors visit again that just as same as they did to me on 2013;
This was just one kind of abuse, for 9 years long, the municipal of Standard has non stop to abuse me and my business as such as: a) requested to have building permit that I don't have to; b) calling all kind inspectors for the results I have no problem; c) the mayor calling everyone not come to support my business; d) the mayor convinced my tenant moved out for cheap rent, and break down the rental contract; e) spraying rumors to kill my business; e) dumped street snow on my both properties; refusal for historical site; f) calling all the inspectors on me again once the AHRC once AHRC accepted my complaint; g) created another bar to steal my business, and the owner is the deputy mayor; h) took over the old school property then turned it down to make sure I unable to bit on for new project I applied for; minimized my hotel business on the municipality official website; i) removed me and my business Facebook out of the village community boarder; and etc....
Our Canadian systems always claimed that the law is equalized to everyone, but the reality is not the same, which my case is a great example: With those kind harassment, I am living with no life quality at all, my both kids moved out from this village, and I was almost suicidal especially during the summer last year once the municipality used excuse to link my hotel for public auction, just because my lawyer didn't respond his email on the day the municipality requested...
I am still waiting for the counterclaim judgment from Queen's Bench Drumheller, and I am also waiting for the tribunal hearing by the AHRC. So what we should expecting the punishment that the Queen's Bench and AHRC will grant?
PC: Actually there are rules to follow between the provincial and municipalities that you may see from the link below. By then I just more wonder about where is this come from as "WE HAVE NO AUTHORITY TO CONTROL THE MUNICIPALITIES..."???
对滥用法律的执法人员的处罚措施
虽然我们幸运地已经进入了文明社会的21世纪,但直到今天,所谓山高皇帝远,关于小城镇政治的反歧视问题,对我们市民来说都是非常重要的。
每当人们投诉市政当局滥用职权时,大多数时候你都会收到诸如“我们无权控制市政当局……”之类的托词;然后他们会和你说可以向监察员或人权委员会投诉。然而投诉过程中,当你意识到你可能需要向法院提出赔偿要求时,却已为时太晚,因为督察机构需要时间来调查你的投诉,不幸的是,当督察机构走完了它的调查程序,你也已经过了你的索赔法定期限(原本民事索赔为期三年现改为两年)。
往往是,当督察机构接到市政的答复,在大多数情况下你的投诉可能会被驳回,因为,不管市政府有多小,即使它可能会撒谎,督察机构及法院都会更多采信市政提交的声明,因为它代表政府。
这就是我案件中发生的问题,尽管市政确实有法律要遵守(阿尔伯塔市政法案 s610),但它仍然选择滥用权力欺凌我长达5 年之久,如果我没有即时解雇我那个不负责任的律师自己出庭维权,法院至今可能还不知道事情的来龙去脉。
当人权委员会 AHRC 要求市政当局回应我的投诉,我的律师和市政串通一起向我施加压力,说服我接受市政提出不公平的庭外和解方案, 并附加立即撤回我向 AHRC 的投诉的条件,否则我可能会因为我在社交媒体上发布了关于市政的问题而引起一场大诉讼......
当我发回我的庭外和解提议时,市政并不回应,犹如2013 年市政对我进行打压手法一样,再次向各部门谎报我经营和装修等方面违规,要求派员督察,;
这只是其中的一种虐待。9年来市政一直以种种方法对我进行打压, 骚扰我和我的生意,例如:a)要求我申请我并不需要的建筑许可证; b) 投诉各部门要求派员督察我的生意和物业维护装修(各检查员检查的结果是我没有问题; c) 镇长呼吁大家不要来支持我的生意; d) 镇长以低廉的租金为诱饵说服我的房客搬出并毁坏租赁合同; e) 散播种种谣言来扼杀我的生意; e) 常年在我的两处房产上倾倒市政街道积雪;f)拒绝为我旅馆申请成为历史遗址; g) 当AHRC 要求市政对我的投诉作出解释时,市政再次要求各部门检查员对我进行调查; h) 市政创建另一个酒吧侵吞我的生意,如同2013年开创另一个餐馆抢夺我的生意如同一澈,而老板就是现任副镇长; i) 市政接管了旧学校的财产,以确保我无法以此物业创建我申请的新项目;j)市政官方网站上尽可能减少关于我酒店业务的宣传; k) 将我和我旅馆移出社区脸书板块;等等....
我们加拿大的制度一直声称法律面前人人平等,但事实并非如此。我的案例就是一个很好的例子:由于市政的一系列骚扰,我的生活根本没有质量,我的两个孩子为了远离是非都选择搬离了小镇,尤其是在去年夏天,市政一次次找借口将我的旅馆进行公开拍卖,其中一个原因只是因为我的律师没有在市政要求的期限回复它的电子邮件,再次定时间拍卖我的旅馆。要不是法庭的法律援助机构及时告诉我如何应对,当时我被逼得几乎自杀。。。
我现在还在等待Queen's Bench Drumheller法庭的反诉判决,同时也在等待AHRC的听证会。那么,我们应该如何期待法庭和 AHRC 对这种知法犯法,滥用权力,草菅人命的市政给予什么样的惩戒呢?
