5.Summary:
5.1 Minutes of the Small Committee is the final agreement on Pension Regulations. As agreed in the minutes, Bank Pensioners are entitled to Pension updation and the formula for updation should be the RBI formula on updation.
5.2 Government of India had approved the minutes of the Small Committee in the Honourable Karnataka High Court. They cannot disapprove the minutes with respect to the updation clause alone.
5.3 Even at the time of negotiating the terms of the Bank Pension Scheme, Banks and Employees have arrived at the consensus that the Pension Schme of Banks will be exactly same as Pension scheme of RBI. As RBI has implemented updation, Banks also should implement updation.
5.4. Relying on the Promise of IBA regarding updation of Pension in line with RBI scheme, the pensioners have altered their position by opting out of the PF scheme and joined the Pension scheme. IBA / Banks are estopped from denying the promise.
5.5 Promises made by IBA/Banks that updation as per RBI formula will be extended have created a Legitimate Expectation in the Pensioners. IBA / Banks have to carry out the promise and fulfil the Legitimate Expectation.
5.6 Banks are earning sufficient profits and will be able to absorb the cost of updation.
6. Prayer:
In view of the foregoing this Honourable Court may be pleased to direct IBA / Banks to update the Pension of Bank Pensioners adopting the RBI formula on updation, with retrospective effect from April 2019 as has been done in RBI.

IN VIEW OF THE FOREGOING, THERE IS NO SCOPE FOR ANY AMBIGUTY OR CONFUSION WHATSOEVER AS TO OUR SUCCESS ON MERITS OF THE CASE.

AT THE BEHEST OF OUR BELOVED FINANCE MINISTER MADAM NIRMALA SITHARAMNJI, THE DFS/MOF ALSO TOOK A FIRM STANCE FOR THE RESOLUTION OF THE TWIN COMMON ISSUES CONCERNING SBI/PSB RETIREES - THOUGH BELATED.
I REPEAT TO SAY AGAIN & AGAIN THAT ......
WHAT ALL THE BENEFITS WE HAVE BEEN DEPRIVED SINCE THREE LONG DECADES HAVE NOW BEEN SECURED ONLY THROUGH LEGAL RECOURSE ULTIMATELY -
ORGANISATIONAL ACHIEVEMENTS ON THE PART OF UFBU HAVE BEEN NIL. ON THE CONTRARY, THEY HAVE BEEN SABOTIZING OUR EFFORTS SINCE OVER THREE DECADES. LESS SAID THE BETTER.
LAST - BUT NOT THE LEAST..
SOME OF OUR LEARNED FRIENDS HAVE BEEN CRITICAL ABOUT MY "DAILY BULLETINS" ... NOTWITHSTANDING ANY COMMENTS FROM SNY QUARTERS , MY ONLY ENDEAVOURS HAVE ALWAYS BEEN TO BRING AWARENESS EVEN AMONG THE AVERAGE SEGMENTS OF OUR FRATERNITY INASAMUCHAS THE AVERAGE MASS-MEMORY IS ALWAYS SHORT-LIVED.
