I opine that this aspect is certainly a glaring technical flaw (on the part of the Madras Division Bench) and equally seems to be a glaring omission on the part of the Hon'ble bench of the Supreme Court as well. For reasons unknown , this has ultimately resulted in ignoring the issues that were taken cognizance/consideration both by the Single Judge of Madras High Court as also those of the Judgments pronounced by the both the benches of Kolkotta High Court. In addition, the judgment has not covered the aspect affecting the fundamental rights (Art.14) of the Constitution. Further, this is very much against the spirit of the judgement pronounced by the very same Supreme Court very recently in the 1616-1684 case. THUS, I AM OF THE STRONG OPINION THAT THE ABOVE JUDGMENT OF THE APEX COURT IS CERTAINLY AN INCHOATE ONE BEYOND ANY DOUBT - EVEN WITHIN THE WISDOM OF AN AVERAGE MAN OF ORDINARY PRUDENCE LIKE ME. ....."
