Hold Malicious Reporters Accountable

The Issue

Our family has endured unimaginable trauma at the hands of a malicious accusation. We were falsely accused of trafficking our children by a woman named Tabitha Holsonback or Tabitha Allen, shortly after her boyfriend, James McElreath, was arrested for attempting to harm my husband with a knife. Her accusation led to invasive and traumatic physical exams for our children, mandated to prove our innocence. This ordeal has left an indelible mark on our children, and we have been repeatedly traumatized by interactions with law enforcement and Child Protective Services (CPS).

CPS, following their protocol, did what they deemed necessary to ensure the safety of our children. However, the accusation was baseless, a product of spiteful retaliation designed to inflict maximum distress on our family. We even handed them the evidence of this being a retaliation tactic.

While the law protects the process implemented by CPS, it also states that filing false reports to emergency services is illegal.

Despite providing evidence from the penal code that such malicious reports are indeed unlawful, we find ourselves at an impasse. The magistrate dismissed the concept of 'malicious reporting,' rendering us without recourse simply because the accuser has relocated to Texas. This legal oversight continues to perpetuate trauma for families like ours who are unjustly targeted by false allegations.

We are calling for urgent reform and accountability in the legal system to prevent further grievances. The judiciary must acknowledge and act against malicious reporting, ensuring that those who abuse the legal system for personal vendettas face appropriate consequences. This essential change is not only about obtaining justice for our family but also about protecting countless others from undergoing similar horrors that are happening all over the world as we speak.

Join us in demanding strict enforcement of laws against filing false reports, and in calling for greater awareness and empathy from judicial officials when handling such sensitive cases. We cannot allow individuals to misuse the legal system to carry out personal vendettas, leaving innocent families to suffer in their wake.

Please read, sign and share this petition to urge lawmakers to take decisive action against malicious reporting and hold those responsible accountable for their actions. Your support can help bring justice to our family and prevent similar tragedies from affecting others.
