The Issue

In a February 9, 2025, social media post, Senator J.D. Vance falsely claimed that judges do not have the authority to check executive power, stating:

 

 

 

These statements are factually incorrect and misrepresent the constitutional role of the judiciary in checking executive power through judicial review. The judicial branch has a fundamental duty to interpret the law and ensure that executive actions comply with the U.S. Constitution. This principle is well established through:

  • Marbury v. Madison (1803) – The Supreme Court has the authority to strike down executive actions that violate the Constitution.
  • Youngstown Sheet & Tube Co. v. Sawyer (1952) – The judiciary ruled against President Truman’s executive order seizing steel mills, reaffirming that courts can and do limit executive power.
  • United States v. Nixon (1974) – The Supreme Court ordered President Nixon to comply with a subpoena, demonstrating that the judiciary has the authority to regulate executive conduct.

Senator Vance’s false and misleading claims undermine public understanding of constitutional checks and balances and contribute to the spread of misinformation about the role of the courts.

We, the undersigned, demand that Senator J.D. Vance:

  1. Publicly correct his false claims about judicial oversight of the executive branch.
  2. Acknowledge the judiciary’s role in checking executive power under the U.S. Constitution.
  3. Commit to responsible public discourse that accurately reflects constitutional principles.

The separation of powers is a fundamental pillar of American democracy, and misleading the public about judicial authority threatens democratic accountability. We urge Senator Vance to immediately retract and clarify his statements to uphold the integrity of public trust in government institutions.

J.D. Vance, a graduate of Yale Law School, is well-versed in constitutional law and the separation of powers, yet he has purposefully misrepresented the judiciary’s role in checking executive authority. As Vice President, his deliberate misinformation misleads the public about the fundamental checks and balances that uphold American democracy, which is deeply concerning for a high-ranking government official.

J.D. Vance is intentionally misrepresenting the judiciary’s role to manipulate the American public by fostering distrust in the legal system and delegitimizing judicial oversight of executive power. By falsely claiming that courts cannot check the executive branch, he is laying the groundwork for an unchecked presidency, where judicial rulings against the administration can be dismissed as illegitimate. This tactic is a classic authoritarian strategy—eroding public confidence in democratic institutions to consolidate executive control. 

JD Vance MUST:

  1. Publicly retract his false statements: correct the record on the way the American Judiciary works.
  2. Issue a formal apology on how he has intentionally mislead the American people
  3. Commit to verifying information before making public statements in the future
