Higher Bonds & Victim Impact consideration
The Issue
On Feb 25th, 2022 our son Wyatt was picked up from daycare unresponsive. If we wouldn't have picked him up when we did, he would have been deceased before he was back into our care. There was no attempt made for medical attention only a video that alarmed me, so I called Wyatt's father to go pick him up. Wyatt was bundled up with a snow cover, so he wasn't visible and Wyatt's dad was told he had fallen asleep. When they arrived home, Wyatt was limp and unresponsive. His father rushed him to the ER where he was soon airlifted to Madison, WI.
After many tests, Wyatt was diagnosed with Abusive Head Trauma, and we were told he would not regain consciousness. His death has been ruled a homicide after all possible tests were completed and we were faced with the decision to remove our innocent baby from life support.
We live in a small town, and the alleged person that admitted being the sole adult that cared for Wyatt that day, is out on a $10,000 cash bond no 10% rule.
As we are learning the Justice system of Wisconsin it has been infuriating. We feel criminals because of the "innocent until proven guilty law" have more rights than the victims already living the ultimate life sentence.
The alleged, was originally charged with neglect resulting in death, after she was caught on camera getting a nipple piercing without any children with her. Months later, she was charged with multiple more neglect charges from a day she was caught shoplifting for 4 HOURS WITHOUT our children!! When they charged her with 1st degree reckless homicide, we thought good, they will raise her bail and she will finally have to do time for what she did.
Unfortunately, we soon learned this is not how the Wisconsin Justice Systems works. In Wisconsin the sole decision on a bond amount is past crimes or flight risk and bonds are not adjusted for additional charges as they can not use a bond amount to incarcerate someone.
We strongly disagree with this. We currently live in a community population of, 2,600. We see the alleged shopping local, swimming local, and enjoying her summer on family vacations. Her husband taunts us by waving as we drive past one another. It has been a big joke to them, with zero remorse and I beg for a change. Something to help ease the heartache and having to run into the person involved in a crime that has completely shattered your life.
Change starts with us. It starts now.
