Are you a Harvard Law School professor of the 21st century?

Or a professor of Japanese Imperial university hundred years ago?

 

Professor Ramseyer's paper, which distorts Japanese war crimes, rationalizes the invasion of neighboring countries as the remarks by Goebbels, the propaganda minister during the Nazi era, and is being used as a megaphone by the Japanese government to take no responsibility for the war of aggression.

 

The title of Professor John Mark Ramseyer's paper, "Contracting for sex in the Pacific War" is going to be published on March, 2021, on International Review of Law and Economics vol. 65.

 

According to the professor's thesis, it claims that the women who became "comfort women" for the Japanese military at the time are just said to have entered into a "contract" for mutual benefit.

 

In particular, he introduced a logic based on "Game Theory" in Economics, arguing that the contract was made because the purposes of the women who made money coincided with the interests of the recruiter and the Japanese military

 

However, "Game Theory" should not be used to analyze sexual slavery crimes during the war. Game Theory is a tool that analyzes parties' free and reasonable decisions or valid contracts.

 

Although the Japanese military "comfort women" system is a system of sexual slavery that is enforced coercively and is not permitted under customary international law and cannot be considered a valid contract, applying game theory to this system is an insult to the victims and advocacy for war crimes.

 

A valid contract must be consistent with the intention and indication of 'expression of will(in legal terms)', and there must be no defects and the content must be legal and have social validity.

 

The girls' sexual slavery contracts are also invalid in the first place because the contracts resulted from flawed expression of will by deception or compulsion.

 

Who could agree to be deprived of self-determination voluntarily without deception or compulsion? And who would agree to the contract knowing that freedom of movement will be restricted and chained to the battlefield?

 

Through the Kono Statement in 1993, the Japanese government has admitted to itself that the recruitment of comfort women was mainly handled by service providers who were requested by the military, but in those cases, many women were also recruited against their will due to sweet-talks or coercion.

 

The content of the sexual slavery contract itself is illegal because it violates customary international law which prohibits slavery, and is invalid because it has lost its social validity.

 

According to an investigation by the Japanese government, the comfort women were deprived of personal freedom, forced to move between bases with the military, denied the right of sexual self-determination, and forced to follow the horrible rules. It was also revealed that the sexual and reproductive health of comfort women were treated like possessions to protect soldiers from sexually transmitted diseases.

 

The treatment of the "comfort women" falls within the ordinary usage of "slavery" and the "slave trade". The women were "deprived of their freedom" and "recruited against their own will". Moreover, some women were purchased and therefore easily fit the classic mould of slavery.

Ignoring the facts that are clearly revealed to the international community likewise, the comfort women system being analyzed in the framework of the game theory on the premise that girls who were victims of war crimes voluntarily signed a contract to benefit themselves is an advocacy for war crimes of sexual slavery, and an overt insult to the victims.

 

Who would dare to say that under the slave trade, slaves voluntarily entered into valid slave contracts in their interests with the slave trader?

 

We criticize the anti-human study that stems from Professor Ramseyer's ignorance or intentional acquiescence.

 

We call on Professor Ramseyer, who has been a puppet of Japanese government, to reflect on and withdraw himself of his study that denies Japanese history of aggression and doing harm.

 

We request the International Review of Law and Economics to withdraw the publication of Professor Ramseyer's thesis.

 

We call on the Dean of Harvard Law School and the President of Harvard University to take disciplinary action on Professor Ramseyer who defames Harvard Law School by violating ethics and conscience as a scholar.

성 노예 전쟁 범죄를 옹호하는 하버드 로스쿨 교수?

일본의 전쟁범죄를 왜곡하는 램지어 씨의 논문은 독일 나치시절 선전장관 괴벨스의 발언처럼 주변 나라들을 침략한 것을 합리화하고 있으며, 침략 전쟁에 대한 책임을 지지 않으려는 일본 정부의 확성기로 활용되고 있습니다.

 

존 마크 램지어 하버드대 교수의 논문 제목은 ‘태평양전쟁 당시 성(性)계약’(Contracting for sex in the Pacific War)으로 ‘인터내셔널 리뷰 오브 로 앤드 이코노믹스’(International Review of Law and Economics) 제65권에 2021년 3월 출간될 예정입니다.

 

논문에서 램지어 교수가 주장한 내용을 보면, 당시 일본군 ‘위안부’가 된 여성들은 서로의 이익을 위해 '계약'을 맺은 것뿐이라고 주장하고 있습니다.

 

특히 그는 경제학에서 말하는 '게임이론(Game Theory)'에 입각한 논리를 도입했고, 돈을 버는 여성의 목적이 모집업자와 일본군의 이해관계와 일치했기 때문에 계약이 이루어졌다고 주장합니다.

 

하지만 '게임이론'은 전쟁 당시 성노예 범죄를 분석하는데 사용하여서는 안 됩니다. 게임이론은 당사자의 자유롭고 합리적인 의사결정 내지 유효한 계약을 분석하는 도구입니다.

 

일본군 ‘위안부’ 제도는 강압적으로 자행되고 국제관습법 상 허용되지 않는 성노예 제도이며 유효한 계약으로 볼 수 없음에도, 이 제도에 게임이론을 적용하는 것은 피해자에 대한 모욕이자 전쟁범죄에 대한 옹호입니다.

 

유효한 계약이란 의사표시의 의사와 표시가 일치하고 하자가 없어야 하며, 내용이 적법하고 사회적 타당성이 있어야 합니다.

 

소녀들의 성노예 계약 또한 기망이나 강박에 의한 하자있는 의사표시에 기한 것으로 애초에 무효입니다.

 

누가 과연 기망이나 강박 없이 자발적으로 자기결정권을 박탈당하고, 이동의 자유가 제한된 채 전쟁터에 구속당할 것을 알고도 해당 계약에 동의할 수 있을까요?

 

고노담화를 통해서 일본 정부는 위안부 모집에 대해서는 군의 요청을 받은 업자가 주로 담당하였으나 그 경우도 감언이나 강압 등에 의한, 본인들의 의사에 반하여 모집된 사례가 많음을 스스로 시인한 바 있습니다.

 

성노예 계약 내용 자체도 노예제도를 금지하는 국제관습법 위반으로 위법하며, 사회적 타당성을 잃어 무효입니다.

 

일본 정부의 조사에 따르면, 위안부들은 인격적 자유를 박탈당하고, 군대와 함께 군 기지 사이 이동을 강제당하고, 성적 자기결정권을 부정당했으며, 무시무시한 규칙을 따르도록 강제당했습니다. 또한 위안부들의 성과 생식에 관한 건강이 장병들을 성병으로부터 지키기 위해 소유물과 같이 취급당했음이 밝혀졌습니다.

 

“위안부”의 처우는 “노예제”와 “노예무역”이라는 말의 통상적인 용법 속에 들어간다. “위안부” 여성들은 “자유를 박탈당하고”, “자신의 의사에 반하여 모집”되었다. 나아가 일부 여성들은 매입되었고, 따라서 고전적인 노예제의 틀에 쉽게 들어맞는다.

이와 같이 국제사회에 명백히 밝혀진 사실을 무시하고, 위안부 제도를 전쟁범죄 피해자 소녀들이 자발적 의사로 자기에게 이익이 되는 '계약'을 맺었음을 전제로 게임이론의 틀로 분석한 것은 성노예 전쟁 범죄에 대한 옹호이며 피해자에 대한 명백한 모욕행위입니다.

 

과연 누가 노예무역 하에서 노예가 노예상인과 자발적으로 자신에게 이익이 되는 유효한 노예계약을 체결하였다고 감히 말할 수 있을까요?

 

우리는 램지어 교수의 무지에서 비롯되었거나 의도적인 묵인에서 비롯한 반인권적인 연구를 비판합니다.

 

우리는 램지어 교수가 일본 정부의 꼭두각시가 되어 일본의 침략과 가해 역사를 부정하는 연구를 한 것을 반성하고 스스로 철회할 것을 요구합니다.

 

우리는 ‘인터내셔널 리뷰 오브 로 앤드 이코노믹스’(International Review of Law and Economics)가 램지어 교수의 논문 게재를 철회할 것을 요구합니다.

 

우리는 하버드 대학 로스쿨 학장과 하버드 대학 총장에 학자로서 윤리와 양심을 저버림으로서 하버드 로스쿨 명예를 훼손하는 램지어 교수를 징계할 것을 요구합니다.
