Halt the mileage reporting to the DMV of Nevada

PETITION TO THE NEVADA LEGISLATURE
Halt the DMV Mileage‑Reporting Pilot Program and Protect Nevadans From Unauthorized Taxation
To the Honorable Members of the Nevada Legislature:
We, the undersigned residents of the State of Nevada, respectfully petition the Legislature to immediately halt the Nevada Department of Motor Vehicles’ mileage‑reporting pilot program and to reaffirm that any mileage‑based tax or data‑collection system must be explicitly authorized by the Legislature and approved through a transparent, democratic process.
WHEREAS: The DMV’s Mileage‑Reporting Pilot Program Exceeds Its Legal Authority
In AB 483 (2019), the DMV requested legislative approval to study alternatives to the gas tax. The Legislature granted limited authority for a study only, stating:
“The Department shall conduct a study concerning the potential impact of alternative methods of funding the State Highway Fund, including a vehicle miles traveled fee.”
AB 483 did not authorize:
mandatory mileage reporting
a statewide pilot program
data collection tied to future taxation
the creation of a Vehicle Miles Traveled (VMT) framework
any requirement imposed on Nevada residents
The DMV’s current pilot program exceeds the scope of authority granted by AB 483 and represents administrative overreach.
WHEREAS: The Program Violates the Nevada Constitution
Under Article 4, Section 1 of the Nevada Constitution:
“The Legislative authority of this State shall be vested in a Senate and Assembly.”
Only the Legislature may impose taxes or create the infrastructure for new taxation.
By collecting mileage data that could be used to implement a VMT tax, the DMV is engaging in taxation without representation, violating:
Article 4, Section 1 — legislative authority
Article 3, Section 1 — separation of powers
No administrative agency may create or prepare for a new tax without legislative approval.
WHEREAS: The Program Threatens Privacy and Opens the Door to Surveillance
Mileage reporting may appear simple, but similar programs in other states have expanded into:
GPS‑based tracking
third‑party data collection
continuous monitoring of driving habits
Nevadans should not be subjected to expanded government surveillance without explicit legislative authorization and robust privacy protections.
WHEREAS: A Mileage‑Based Tax Would Harm Nevada Residents Economically
A VMT tax would disproportionately burden:
rural residents who must drive long distances
working families with long commutes
small businesses dependent on transportation
seniors and low‑income Nevadans
At a time of rising costs for fuel, insurance, registration, and vehicle maintenance, Nevadans cannot afford another layer of taxation.
THEREFORE, WE THE UNDERSIGNED PETITION THE LEGISLATURE TO:
1. Immediately suspend the DMV mileage‑reporting pilot program.
2. Clarify that AB 483 (2019) did not authorize mandatory mileage reporting or VMT implementation.
3. Affirm that any mileage‑based tax proposal must originate in the Legislature, not through administrative action.
4. Require full public hearings, transparency, and public input before any new transportation‑funding model is considered.
5. Protect Nevada residents from unauthorized data collection and taxation without representation.
