The Issue
Wallis Park Property Limited have submitted a planning application for a 10-storey building, plus basement located at Rahim Brothers Ltd, Atlas Wharf Berkshire Road, Hackney, London, E9 5NB. This site is surrounded by a residential neighbourhood. It is less than 60m from Mossbourne Riverside Primary Academy and less than 140m from Gainsborough Primary School and Nursery.
The applicant's own Contamination Report Executive Summary notes:
"Given the site’s environmental setting and known history, contamination is considered to present a MODERATE risk to end users and a HIGH risk to groundwater receptors." (pg. 5)
In addition it notes:
- "During development earthworks, there is considered to be a short term VERY HIGH risks to groundworkers and HIGH RISK to neighbours as a result of fugitive dust emissions. This is mainly dues to the percent-level concentrations of highly toxic, inorganic forms of arsenic in Made Ground...and other contaminants of concern recorded at high concentrations." (pg. 24)
- "Following site development, there is an overall HIGH RISK to groundwater and MODERATE RISK to student residential / commercial end users." (pg. 24)
- "A HIGH RISK is associated with contamination in Made Ground and potable water pipework." (pg. 24)

REQUESTED CONDITIONS
Due to the site's contaminated nature, the community requests the following:
- Detailed Plan to Prevent Community Exposure
- A detailed strategy and set of tactics demonstrating how the development will prevent community exposure to harmful substances.
- This strategy should demonstrate consideration of the aggregated, long-term exposure of the community to harmful substances from construction sites in Hackney Wick over the last 15 years.
- Quantitative data evidence supporting the rationale for the strategy and tactics.
- Quantitative data for safe exposure levels for children aged 0 and up.
- Evidence of Financial Capability for Prevention Measures
- Evidence of the developer’s financial capacity to fully fund all required prevention measures and potential site remediation.
- Independent Environmental Monitoring on the Site
- All monitoring is carried out by an independent third party. This includes nuisance odour monitoring.
- Baseline monitoring is conducted before any investigation or construction activity begins.
- Ongoing monitoring is carried out continuously throughout the full construction period.
- New passive air quality monitors in the community
- Fund new passive air quality monitor at all nurseries and schools within a minimum 600m radius of the site.
- Real-Time, Publicly Accessible Data
- Construction site air quality monitoring results are available in real time.
- All data is published and hosted by an independent third party.
- Pre-Defined Maximum Thresholds and Response Procedures & Accountability
- Clear maximum thresholds for harmful substances are established before site investigations and construction commences.
- Defined, enforceable procedures detailing what actions will be taken if thresholds are exceeded. This includes a Responsibility, Accountability, Consulted, and Informed matrix.
- Community Engagement and Escalation Routes
- A comprehensive community-engagement plan setting out how residents will be informed and consulted.
- Defined points of contact and clear pathways for raising concerns or escalating issues during site preparation, construction, and ongoing monitoring.
