ஆதரவு கோரிக்கை... 

இந்தியாவில் வாழும் இலங்கைப் பூர்வீகத் தமிழர்கள், இந்திய வம்சாவளித் தமிழர்கள் மற்றும் நாடற்ற தமிழர்களுக்கு நியாயமான மற்றும் நிரந்தரமான தீர்வு இந்திய குடியுரிமை மட்டுமே.

நான்கு தசாப்தங்களுக்கும் மேலாக, இலங்கையிலிருந்து வந்த ஆயிரக்கணக்கான தமிழ் குடும்பங்களும் அவர்களின் சந்ததியினரும் தமிழ்நாட்டில், இந்தியாவில் வாழ்ந்து வருகின்றனர். இவர்களில் பலர் இந்தியாவில் பிறந்து, இங்கேயே கல்வி கற்று, தங்களது வாழ்வாதாரத்தை உருவாக்கி, தலைமுறைகளாக இந்திய சமூகத்தின் ஒரு பகுதியாக வாழ்ந்து வருகின்றனர்.
இந்த சமூகத்தினர் அனைவரும் ஒரே மாதிரியான பின்னணியைக் கொண்டவர்கள் அல்லர். இவர்களில் இலங்கைப் பூர்வீகத் தமிழர்கள், இந்தியாவை பூர்வீகமாகக் கொண்ட இந்திய வம்சாவளித் தமிழர்கள், நாடற்ற நிலையில் வாழும் தமிழர்கள், இந்தியாவில் பிறந்து வளர்ந்தவர்கள் மற்றும் பல தலைமுறைகளாக இந்தியாவுடன் ஆழமான தொடர்பைக் கொண்ட குடும்பங்கள் உள்ளனர்.
எனவே, ஒவ்வொரு நபரின் தனிப்பட்ட வரலாறு, பிறந்த இடம், குடும்பப் பின்னணி, பூர்வீகம் மற்றும் இந்தியச் சட்டத்தின்  அடிப்படையில் நியாயமான, சட்டபூர்வமான மற்றும் நிரந்தரமான தீர்வு வழங்கப்பட வேண்டும் என நாங்கள் கோருகிறோம்.

எங்களது வேண்டுகோள்
இந்திய அரசு, தமிழ்நாடு அரசு, அரசியல் கட்சிகள், மனித உரிமை அமைப்புகள், சமூக அமைப்புகள், சட்ட நிபுணர்கள் மற்றும் மக்கள் பிரதிநிதிகள் இணைந்து பின்வரும் நடவடிக்கைகளை மேற்கொள்ளுமாறு கேட்டுக்கொள்கிறோம்:
- ஒவ்வொரு நபரின் குடியுரிமை கோரிக்கையும் தனிப்பட்ட முறையில் தீர்மானிக்கக்கூடிய தெளிவான மற்றும் எளிதில் அணுகக்கூடிய நடைமுறையை உருவாக்குதல்;

- இந்தியச் சட்டத்தின் கீழ் ஏற்கனவே குடியுரிமைக்குத் தகுதியுடையவர்களின் குடியுரிமை உரிமையை அங்கீகரித்தல்;
- பதிவு அல்லது இந்தியச் சட்டத்தின் கீழ் கிடைக்கக்கூடிய பிற குடியுரிமை வழிமுறைகளுக்கு ஏற்றவாறு மனிதநேயமான மற்றும் நடைமுறைக்கு ஏற்ற குடியுரிமைப் பாதையை ஏற்படுத்துதல்;
- பல தசாப்தங்களாக நாடற்ற நிலையில் அல்லது உறுதியான தேசிய அடையாளமின்றி வாழ்ந்து வருபவர்களுக்கு நிரந்தரமான சட்டத் தீர்வை உருவாக்குதல்;
- இந்தியாவில் பிறந்த தலைமுறைகள் மற்றும் நீண்டகாலமாக இந்தியர்களுடன் திருமணம் உள்ளிட்ட ஆழமான தொடர்பைக் கொண்ட குடும்பங்களுக்கான வெளிப்படையான கொள்கையை உருவாக்குதல்.
இது ஏன் முக்கியமானது?
குடியுரிமை என்பது வெறும் நிர்வாக ஆவணம் மட்டுமல்ல. அது ஒருவரின் அடையாளம், மனித கண்ணியம், கல்வி, வேலைவாய்ப்பு, சுதந்திரமான பயணம், குடும்பப் பாதுகாப்பு மற்றும் சமூகத்தில் முழுமையாகப் பங்கேற்கும் உரிமை ஆகியவற்றுடன் தொடர்புடையது.
இந்தப் பிரச்சினையின் பல்வேறு அம்சங்கள் ஏற்கனவே இந்திய நீதிமன்றங்களின் கவனத்திற்கும் வந்துள்ளன.
Nalini v. Regional Passport Officer (W.P.(MD) No.3512 of 2022) வழக்கில், குடியுரிமைச் சட்டத்தின் Section 3(1)(a)-ன் கீழ் தொடர்புடைய காலகட்டத்தில் இந்தியாவில் பிறந்த ஒருவர் பிறப்பின் அடிப்படையில் இந்தியக் குடிமகனாக இருப்பதன் முக்கியத்துவத்தை சென்னை உயர்நீதிமன்றம் எடுத்துரைத்தது.
Harina v. Regional Passport Officer (W.P.(MD) No.27893 of 2022) வழக்கில், இலங்கை அகதி பெற்றோருக்குப் பிறந்து இந்தியாவில் வளர்ந்த ஒருவரின் நிலை குறித்து நீதிமன்றம் பரிசீலித்ததுடன், நாடற்ற நிலை மற்றும் தேசியத்திற்கான உரிமை தொடர்பான சர்வதேசக் கோட்பாடுகளையும் கருத்தில் கொண்டது. அதேவேளை, 1954 மற்றும் 1961 நாடற்ற நிலை தொடர்பான சர்வதேச உடன்படிக்கைகளில் இந்தியா உறுப்பினராக இல்லை என்பதையும் நீதிமன்றம் குறிப்பிட்டது.

இந்த வழக்குகள் ஒவ்வொரு நபரின் சூழ்நிலையையும் மனித கண்ணியம், நியாயம், மனிதநேய அக்கறை மற்றும் சட்டத்தின் ஆட்சி ஆகிய அடிப்படைகளில் பரிசீலிக்க வேண்டியதன் முக்கியத்துவத்தை எடுத்துக்காட்டுகின்றன.

இந்த நீண்டகாலப் பிரச்சினையை உரிய அரசாங்க அமைப்புகளின் கவனத்திற்கு கொண்டு சென்று, நிரந்தரமான தீர்வை உருவாக்குவதற்காக நாங்கள் தொடர்ந்து சட்ட, அரசியல் மற்றும் சமூக முயற்சிகளை மேற்கொண்டு வருகிறோம்.

இந்த முயற்சிக்கு:
அரசியல் கட்சிகள், மனித உரிமை அமைப்புகள், சமூக இயக்கங்கள், சட்ட நிபுணர்கள், சமூக செயற்பாட்டாளர்கள், தன்னார்வலர்கள், உலகத் தமிழர் சமூகத்தினர், புலம்பெயர் தமிழர் அமைப்பினர் மற்றும் மனிதநேய உணர்வு கொண்ட அனைவரும்

Grant Indian citizenship to Stateless people, Indian origins and Sri Lankan Tamil refugees

The Issue
A Just and Permanent Citizenship Solution for Sri Lankan-Origin, Indian-Origin and Stateless Tamils Living in India
For more than four decades, thousands of Tamil families from Sri Lanka and their descendants have lived in Tamil Nadu, India. Many were born in India, educated here, built their livelihoods here, and have lived for generations as part of Indian society.

This community is not a single, uniform group. It includes Sri Lankan-origin Tamils, Indian-origin Tamils whose ancestral roots are in India, stateless Tamils, people born and raised in India, and families with deep and multi-generational ties to India.
We therefore call for a fair, lawful and permanent solution based on each person's individual history, place of birth, family background, ancestry and eligibility under Indian law.
Our Appeal
We call upon the Government of India, the Government of Tamil Nadu, political parties, human-rights organisations, civil-society groups, legal experts and public representatives to work together towards:
A clear and accessible mechanism to determine citizenship eligibility on an individual basis;
Recognition of citizenship rights wherever a person is already entitled to Indian citizenship under law;
A humane and practical pathway to Indian citizenship for those who are legally eligible for registration or other forms of citizenship;
A lasting legal solution for persons who have remained stateless or without a secure nationality for decades;
A transparent policy for India-born generations and families with long-standing ties to India.
Why This Matters
Citizenship is not merely an administrative document. It affects a person's identity, dignity, education, employment, mobility, family security and ability to participate fully in society.
Indian courts have already addressed aspects of this issue. In Nalini v. Regional Passport Officer (W.P.(MD) No.3512 of 2022), the Madras High Court recognized that a person born in India during the relevant period under Section 3(1)(a) of the Citizenship Act is an Indian citizen by birth.
In Harina v. Regional Passport Officer (W.P.(MD) No.27893 of 2022), the Court considered the difficulties faced by a person born and brought up in India to Sri Lankan refugee parents and referred to international principles concerning statelessness and the right to nationality, while also noting that India is not a party to the 1954 and 1961 Statelessness Conventions.
These cases demonstrate the importance of examining each person's circumstances with human dignity, fairness, humanitarian concern and the rule of law.
