The Issue

James Allen has been incarcerated for over a decade for a crime he maintains he did not commit. He was pressured into taking a plea deal by his lawyer, who assured him it was the best option at the time. However, new evidence has come to light that supports James's innocence and suggests that the original investigation was flawed.

According to the Innocence Project, there have been 367 DNA exonerations in the United States since 1989. Of those cases, 14% involved false confessions or guilty pleas. This statistic highlights how common it is for innocent individuals to plead guilty due to coercion or misinformation.

James was arrested at the age of 18 and charged with a crime based on circumstantial evidence that was later shown to be unreliable. Despite this, James was pressured into taking a plea deal by prosecutors who threatened him with harsher penalties if he went to trial.

Since his imprisonment, new evidence has come to light that further supports James' innocence. This evidence includes DNA evidence that was mishandled by the Toledo Police Department. This evidence was not available at the time of his trial and could have changed the outcome if it had been presented. Yet despite this evidence, James remains behind bars because he cannot withdraw his plea.

Furthermore, James is now 28 years old and has had no history of violence since his incarceration at ODRC. He has participated in rehabilitation programs and helped other inmates turn their lives around. He is committed to making positive changes in his life and deserves a second chance at life outside of prison walls.

It is clear that justice was not served in this case, and keeping an innocent man behind bars serves no purpose other than perpetuating a miscarriage of justice.

We believe that justice would be better served by granting James clemency or a reduced sentence. This would allow him the opportunity to reintegrate into society as a productive member and contribute positively to his community. We urge those with the power to do so to review his case and grant him the freedom he deserves.
