Government: change DMV 3(harassment) to just harassment after the probationary period.
The Issue
DMV 3 is just harassment, it can stem from threatening someone on the phone to an accident to an excuse for police to arrest a man.
The word "Domestic Violence" by itself, carries a stigma to anyone seeking employment in an already volatile system. Potential doctors, engineers, managers...etc. ,will be excluded from an already unstable employment market to establish gainful employment because of the stigma associated with the word.
A senator in 2003 proposed the bill allowing individual city enforcement to press charges independent of the alleged victim, often threatening the alleged victim with incarceration unless they cooperated with submission of evidence. (ie. signing of papers, pictures of bruises that were from the result of something else, a skin condition...etc)
In addition, there is also incidents where a mother manipulates the system and makes false accusations and therefore uses this law as a crutch to gain full custody of children.
The senator who proposed this law himself, even said that innocent people will probably be convicted of this crime, but if it saves one life it is worth it. My question is what about the lives it destroys? Many states do not offer expungement or the ability to have your records sealed. The alleged victim does not even have to call the police or press charges, a third party can inform. This law is very biased against men, although I do concur that if one life is saved, it is worth it. Although, I also believe that no man should have to endure such a stigma as a wife beater when he did not even raise a hand to a woman.
