From Defective Homes to Dangerous Streets: The System is Failing Victoria.
The issue
The Crisis: A Financial and Physical Trap
Building Defects. Crushing Debt. Rising Crime. Government Inaction.Victoria Must Act!
Imagine buying your home, paying your mortgage, and doing everything right—only to discover your building has serious structural defects that could cost millions to repair. Now imagine being told that fixing those defects is entirely your responsibility, even though you had no role in designing, constructing, or approving the building.
For the owners of South Yarra Square (100 Commercial Road), this nightmare is reality. Severe construction defects have forced extensive emergency works, driving mounting debt and potential rectification costs estimated at $16 million to $24 million+. These are people’s homes and life savings, yet ordinary Victorians are being left to shoulder the catastrophic financial burden of defects they did not create.
A Community Under Threat
Simultaneously, the building's vulnerable state has been exploited by criminal elements. Over the last 18 months residents endured a severe escalation in anti-social behaviour, including overt drug supply and violence from one tenant with alleged gang affiliations. Despite daily police calls and extensive CCTV evidence, authorities and VCAT failed to actively intervene. Instead, they cited the rights of the accused, prioritising a perpetrator's housing security over the community's physical safety. The South Yarra Square community was forced to install extensive security systems and hire 24-hour private security, at great expense, to have the tenant removed.
Current laws incentivise criminal behaviour, protect perpetrators, and provide little to no protection for victims.
The System is Broken
The Victorian Government has explicitly refused to provide compensation or even meet with residents, admitting that recent building reforms do nothing to help homeowners trapped in defective buildings constructed between 1994 and 2026.
Instead of accountability, local councils are weaponising ratepayer money to adopt a “deny, deny & defend" legal strategy; attempting to financially exhaust constituents rather than answer for historical building approval failures.
South Yarra Square exposes a catastrophic failure in Victoria’s building and justice systems—one that leaves ordinary Australians financially devastated and physically unsafe in their own homes, while true accountability remains out of reach.
We Demand Action
We call on the Victorian Government and all political parties to step up and:
- Establish a Legacy Building Rectification Fund: Provide urgent financial relief for owners facing catastrophic costs from historical building defects they did not cause.
- Reform Criminal Laws & VCAT: Introduce stronger protections that prioritise the safety of the community over the rights of violent or criminal offenders in residential buildings.
- Enforce Local Government Accountability: Legislate to force local councils to adhere to Model Litigant Guidelines, ending drawn-out, taxpayer-funded legal battles against constituents.
- Strengthen Building Laws: Mandate independent inspections and strict accountability for those who design, construct, and approve defective buildings.
- A home should provide security, not become a financial disaster and a haven for crime.
Sign this petition to demand justice for South Yarra Square and meaningful, protective reform for all Victorians. Communities deserve better.
