LIBÉRATION DE THÉO CLERC : UN APPEL À LA JUSTICE ET À LA CLÉMENCE

Depuis le 31 mars 2024, notre frère, ami et collègue, Théo Clerc, est emprisonné en Azerbaïdjan. Théo, 38 ans, est un artiste reconnu dans le monde du graffiti et un constructeur talentueux basé à Paris. Lors de son séjour à Bakou avec deux amis, il a réalisé un graffiti sur une rame du métro de la ville. Ce type de travail artistique est une pratique qu’il a déjà exercée dans de nombreux pays à travers le monde, souvent avec des retours positifs.

Cependant, après avoir terminé leur œuvre et s’apprêtant à quitter le pays, Théo et ses deux amis ont été interpellés par la police. Ses amis, un Australien et un Néo-Zélandais, se sont vu confisquer leur passeport et sont assignés à rester dans le pays depuis. Ils devraient pouvoir retourner dans leur pays, si tout va bien, après l’appel. Ils écopent d’une amende de 3600 euros chacun en plus des 8000 euros déjà payés collectivement. Théo, quant à lui, a été incarcéré et vient d’être condamné à trois ans de prison ferme.

La gravité de cette peine nous paraît disproportionnée et injuste. Théo subit une sanction bien plus sévère, apparemment liée à sa nationalité française. Cette disparité de traitement est difficile à comprendre et à accepter. Nous croyons fermement que, selon les lois azerbaïdjanaises elles-mêmes, Théo n’aurait pas dû être condamné à une peine de prison.

Théo n’est pas un criminel. C’est un artiste passionné, dont l’intention n’a jamais été de causer du tort ou de manquer de respect au peuple azerbaïdjanais. Il a d'ailleurs écrit une lettre personnelle au Président Ilham Aliyev pour exprimer ses profondes excuses. Son acte, bien qu’irréfléchi, était purement artistique et ne contenait aucune visée politique. La pratique du graffiti est de plus en plus reconnue mondialement comme une forme d’art urbain, exposée dans des galeries et des institutions culturelles.

Depuis son arrestation, Théo endure des conditions de détention difficiles. Il partage une petite cellule avec deux autres détenus, et doit payer pour accéder à des biens essentiels. La nourriture qu'il reçoit provient uniquement des familles des codétenus, et il est isolé dans un environnement dont il ne maîtrise ni la langue ni les codes culturels.

Cette situation nous inquiète profondément, tant pour sa santé mentale que physique. Théo mérite de rentrer chez lui, auprès de sa famille et de ses amis. Il ne représente aucune menace pour la sécurité ou la souveraineté de l'Azerbaïdjan.

Nous faisons appel à la clémence du Président Ilham Aliyev et aux autorités azerbaïdjanaises pour réévaluer sa peine et permettre sa libération. En cette période où les relations diplomatiques entre la France et l'Azerbaïdjan traversent des moments délicats, ce geste humanitaire pourrait contribuer à apaiser les tensions et à ouvrir la voie à un dialogue plus serein.

FREE THÉO CLERC: A CALL FOR JUSTICE AND CLEMENCY

Since March 31, 2024, our brother, friend, and colleague, Théo Clerc, has been imprisoned in Azerbaijan. Théo, 38 years old, is a well-known graffiti artist and builder based in Paris. During his trip to Baku with two friends, he painted graffiti on a subway car in the city. This artistic work is something he has done in many countries around the world, often receiving positive feedback.

However, after finishing their artwork and preparing to leave the country, Théo and his two friends were detained by the police. His friends, an Australian and a New Zealander, had their passports confiscated and have been ordered to remain in the country ever since. They should be able to return to their country, if all goes well, after the appeal. They will be fined 3,600 euros each on top of the 8,000 euros already paid collectively. Théo, on the other hand, was incarcerated and recently sentenced to three years in prison.

The severity of this sentence feels disproportionate and unjust. Théo faces a much harsher punishment, seemingly linked to his French nationality. This unequal treatment is hard to comprehend and accept. We strongly believe that, according to Azerbaijani law itself, Théo should not have been sentenced to prison.

Théo is not a criminal. He is a passionate artist who never intended to harm or disrespect the people of Azerbaijan. In fact, he wrote a personal letter to President Ilham Aliyev expressing his deep apologies. His act, though impulsive, was purely artistic and had no political intent. Graffiti art is increasingly recognized worldwide as a legitimate form of urban expression, showcased in galleries and cultural institutions.

Since his arrest, Théo has endured difficult conditions in prison. He shares a small cell with two other inmates and must pay for basic necessities. The food he receives comes only from the families of other prisoners, and he is isolated in an environment where he does not understand the language or the cultural norms.

We are deeply concerned for his physical and mental well-being. Théo deserves to come home to his family and friends. He poses no threat to Azerbaijan’s security or sovereignty.

We appeal to the compassion of President Ilham Aliyev and the Azerbaijani authorities to reconsider his sentence and allow his release. In these times of diplomatic tension between France and Azerbaijan, this humanitarian gesture could help ease tensions and pave the way for more constructive dialogue.

2024-cü il martın 31-dən bəri qardaşımız, dostumuz və həmkarımız Théo Clerc Azərbaycanda həbsdədir. 38 yaşlı Théo, Parisdə yaşayan tanınmış qrafiti sənətçisi və inşaatçıdır. O, iki dostu ilə birlikdə Bakıya səfəri zamanı şəhərin metro vaqonuna qrafiti çəkmişdir. Bu cür bədii yaradıcılığı o, dünyanın bir çox ölkələrində həyata keçirib və tez-tez müsbət rəy alıb.

Lakin onlar əsərlərini bitirdikdən və ölkəni tərk etməyə hazırlaşarkən Théo və iki dostu polis tərəfindən saxlanılıb. Onun dostları, avstraliyalı və yeni zelandiyalı, hər biri 3800 avro cərimə ödədikdən sonra azadlığa buraxılıblar. Théo isə həbs edilib və bu yaxınlarda 3 il azadlıqdan məhrumetmə cəzasına məhkum olunub.

Bu cəza bizə proporsional və ədalətli görünmür. Eyni hadisədə iştirak edən iki yoldaşı evlərinə qayıda bildikləri halda, Théo daha sərt cəza ilə üzləşir, görünür ki, onun fransız milliyyətinə görə. Bu qeyri-bərabər münasibəti başa düşmək və qəbul etmək çətindir. Biz inanırıq ki, Azərbaycan qanunlarına görə Théo həbsə məhkum edilməməli idi.

Théo cinayətkar deyil. O, heç vaxt Azərbaycan xalqına zərər vermək və ya hörmətsizlik etmək niyyətində olmayan ehtiraslı sənətkardır. O, hətta Prezident İlham Əliyevə öz səmimi üzrxahlığını ifadə edən şəxsi məktub yazıb. Onun hərəkəti düşünülməmiş olsa da, sırf bədii idi və siyasi məqsədlər daşımırdı. Qrafiti sənəti dünyada getdikcə daha çox tanınır və bir çox qalereyalarda və mədəniyyət institutlarında nümayiş etdirilir.

Onun həbsi Théo üçün ağır həbs şəraiti ilə nəticələnib. O, iki digər məhbusla kiçik bir kameranı bölüşür və əsas ehtiyacları ödəmək üçün pul ödəmək məcburiyyətindədir. O, yalnız digər məhbusların ailələrindən ərzaq alır və dilini və ya mədəni qaydalarını başa düşmədiyi bir mühitdə təcrid olunub.

Biz onun fiziki və psixoloji rifahı üçün dərin narahatlıq keçiririk. Théo ailəsinin və dostlarının yanına qayıtmağa layiqdir. O, Azərbaycanın təhlükəsizliyinə və ya suverenliyinə heç bir təhlükə yaratmır.

Biz Prezident İlham Əliyevin və Azərbaycan hakimiyyətinin mərhəmətinə müraciət edərək onun cəzasının yenidən nəzərdən keçirilməsini və azad olunmasını xahiş edirik. Fransa və Azərbaycan arasında hazırda gərgin diplomatik münasibətlər fonunda bu humanitar jest gərginliyi azaltmağa və daha konstruktiv dialoq yolunu açmağa kömək edə bilər.
