The issue

Paragraph 1 – Who is impacted?
For over a decade, the Palestinian people—particularly those in the West Bank and Gaza—have suffered not only under brutal Israeli occupation but also from the repressive and undemocratic leadership of Mahmoud Abbas. Civilians, political activists, resistance fighters, journalists, and student leaders have been detained, harassed, and silenced by the Palestinian Authority under Abbas's rule. His security coordination with the Israeli military has resulted in the direct or indirect imprisonment and death of countless Palestinians struggling for freedom.

Paragraph 2 – What is at stake?
If Mahmoud Abbas continues to rule without accountability or electoral legitimacy, the Palestinian cause will remain fragmented and weakened. His political survival enables further normalization with the occupier, continued suppression of civil liberties, and erosion of internal unity. But if the international community and legal systems act now—particularly the International Criminal Court—we can initiate a path toward justice, democratic representation, and the revival of genuine Palestinian self-determination.

Legal Grounds for Accountability:
🇵🇸 Under the Palestinian Basic Law (Constitution):
Article 36: Limits the presidential term to four years, renewable only once via election. Abbas’s term legally ended in 2009.
Article 2 & 9: The state is based on democratic governance and guarantees equal rights and freedoms. Abbas has repeatedly violated these articles by repressing opposition and avoiding elections.
Article 10: Committed to human rights and international law—both undermined by political detentions and unlawful arrests under his authority.
🌐 Under International Law and the Rome Statute (ICC):
Article 7 (Crimes Against Humanity):

Persecution of individuals on political grounds.
Imprisonment or severe deprivation of liberty in violation of international norms.
Article 25: Individual criminal responsibility for aiding or abetting war crimes, including support to a regime engaged in ethnic cleansing and apartheid.
Customary international law: Prohibits collaboration with an occupying power in the oppression of one’s own population.
Abbas’s ongoing security coordination with the Israeli military, despite ongoing crimes in Gaza and the West Bank, makes him complicit in maintaining an illegal and oppressive regime.

Our Demands:
We, the undersigned, demand the following:

That the International Criminal Court open a preliminary investigation into the conduct of Mahmoud Abbas for his role in:

Aiding and abetting the Israeli occupation;
Suppressing Palestinian freedoms;
Violating international human rights and constitutional obligations.
That legal bodies, human rights institutions, and democratic governments worldwide:

Refuse to recognize Abbas’s authority;
Cut political ties with the Palestinian Authority under his leadership;
Support the Palestinian people’s right to elect new leadership free from fear and repression.

Closing Statement:
Mahmoud Abbas no longer speaks for us. He rules without a mandate, cooperates with those who kill our people, and undermines the right to resist oppression. His betrayal is legal, moral, and political.
