Free Foad Farahi - End Illegal Detention

The Issue

## URGENT: Protect U.S. Community Leader, Prevent a Humanitarian Crisis

To: Secretary Kristi Noem, U.S. Department of Homeland Security

For over 20 years, Foad Farahi has served as a bridge between communities - leading interfaith dialogue, organizing peace forums, and serving hundreds of families as an imam in North Miami Beach. Now he faces a life-or-death crisis that demands immediate intervention.

As an Iranian national in today's volatile political climate, Mr. Farahi faces persecution if deported anywhere - a reality your own department has officially recognized by granting him protection from removal to Iran. Yet he has been held in immigration detention since June 2025, far exceeding the 90-day statutory limit and violating federal law. We respectfully ask for his immediate release.

### The Injustices

Twenty Years of Retaliation: In 2004, FBI agents approached Mr. Farahi to become a secret informant in his mosque. He offered to arrange public meetings between the FBI and his community but refused to spy in secret. The government has retaliated with deportation proceedings ever since.

Life-or-Death Stakes:
- The U.S. officially recognizes he faces persecution in Iran
- He has legal status neither in Kuwait where he was born, nor anywhere else
- Current political climate in Iran puts political dissidents at extreme risk
- His 20-year case is well-documented, making him a target in any country
- Your department threatens "third country" deportation to places like El Salvador or South Sudan - countries with severe human rights crises

Community Contributions Lost:
- Served as imam at North Miami Beach mosque for 20+ years, enriching  the lives of hundreds of local families
- Led interfaith dialogue efforts, teaching about Islam at Christian & Jewish centers
- Organized peace forums and interfaith dinners across religious communities

### Legal Violations and Considerations

- 90+ days beyond statutory detention limits- a clear violation of 8 U.S.C. § 1231
Indefinite detention without deportation plan violates due process
Federal habeas corpus petition filed arguing constitutional violations
Your own department admits they cannot safely deport him anywhere

### What We Ask

Secretary Noem, you have the authority to end this injustice today:

1. Release Mr. Farahi immediately under supervision while his case is resolved
2. End the third-country deportation threats that would put his life at risk
3. Restore his previous reporting status that he faithfully maintained for years
4. Stop using indefinite detention as punishment for refusing FBI cooperation

### The Bottom Line

A religious leader who built bridges between communities for decades faces potential death if deported anywhere. He's being held illegally by the same government that acknowledged he needs protection. After refusing to become an FBI spy, he's been punished with indefinite detention that violates U.S. law.

The government cannot keep him forever, and they cannot safely send him anywhere. The only legal and humane solution is release.
