There is a way of saving an exempted dog that loses its exempted status. As in Francis case all we would need to do is to reinstate court proceedings under section 4b of the dangerous dogs act 1991 with a new keeper. The simplest way to explain this is that the new legislation only relates to exempted dogs therefore ownership in that situation can only be transferred if the owner is ill or dies. However if the dog becomes unexempted and in Francis CAS as it has been taken in by Battersea and the owner can't or won't fulfill the conditions under the exemption order then the dog reverts to being a prohibited dog and that legislation does not apply. This means the original legislation for prohibited dogs under s4b DDA1991 does apply. The change of keepership in such situations is a red herring it is all about whether the dog has exempted status or not. #savefrancis #EndBSL
