I confirm that I received the attached letter from the Cork City Council Legal Office on the afternoon of the 3rd Dec 2019. It was probably raised further to my flyer handouts at the local election vote count center on Saturday and at the local tourism breakfast on Monday. The Lord Mayor being one who was at the vote count could have notified Corporate and External Affairs Dept of my flyer distribution effort. He might also take the opportunity as a doctor/businessman to explain to Corporate and External Affairs the business requirement for commercial viability and what provides for that. However I will for the moment take it that the letters arrival is more coordinated with the Open Top Bus service having ended for this years season. This is just another synergy of how their unfair favoritism is being worked for the benefit of the Open Top Bus Operator.
The letter as received today is no different from what they were seeking this time last year. They were looking then to repossess the train which was a pretty unfriendly gesture by their Director of Corporate and External Affairs. He is seeking to do this in anger at himself for transferring the locomotive into my name and his annoyance that I would not work from his selected remote pick up set down positions. My best efforts to get myself off the unemployment register and the best they can do is seek to destroy me with back street positioning and thus provide all the business to the Open Top Bus Operator. We cannot work from positions that have no available customers and that is all that the Director of Corporate and External Affairs remote positions offer.
The Directors motivation for pursuing this aggressive path is that of him being responsible for transferring the locomotive ownership to obviate the need for the Council being involved in the vehicle insurances. He is being acutely vindictive in his approach and it is being exercised in the unfair form of his office wishing to repossess the train..... as if so to speak to teach me a lesson for not working the remote positions. That vindictiveness also fed into the stopping of the build on the 2nd carriage as well as facilitating the declared favoritism that was adopted towards the Open Top Bus Operator. As it happened the transfer of the locomotive into my name was of no real benefit to me but the Director of Corporate and External Affairs had a view of it that he had done me a favor. His repossession effort is him seeking to do a reverse on that matter and he is using the non commercial reality of his back street positioning offers to now help progress that unfair effort.
The fact remains that the Council destroyed the investment in the Tourist Train Project and furthermore in their intransigence allowed the train to sit unused and to rust so that it is of no use to anybody in its current state. This is on account of then having provided it with a back street remote operating position that would have busted the business. They would not even let me use it at any other tourist catchment and thus I was unable to make a living. I even offered to work it from the remote position if I was suitably supported.... but Corporate and External Affairs would do nothing to properly assist. The strategy employed by Corporate and External Affairs towards the Tourist Train project seen them loose the value of the Councils support funding to the project as well as destroying the value in the business for the business promoter and all is reflected in them having no regard to the investors in the project and that all happened in the shadow of their favoritism approach. They now seek to cover their failed strategy approach by attacking me as per their letter. That failed approach by Corporate and External Affairs is not putting the value back in the business.
We trialed the remote position and notified them of its non performance but they would not provide us with a commercially viable position. The vindictiveness was again raising its head and that was not how the contract determined how such matters should be addressed. It was a particularly ruthless approach by Corporate and External Affairs. Their letter is unfair and indeed their seeking to leave us to operate at the remote location was them showing how they could ruthlessly leverage the power of local government in that false effort. All in the interest of favoritism they have towards the Open Top Bus Operator. It must be great for the Open Top Bus Operators that they have the City Councils upper floors working so hard for them.
I will be answering the letter to the Cities Legal Office in full in due course and presenting it here as a update. In the mean time I will continue my efforts to bring a focus on the unfair favoritism issue that has contaminated the workings of the Tourist Train contract. The workings of unfair favoritism are so embedded in City Hall that I will be approaching my response from the point of view of having that in mind.
