This petition is for Tommy Whack a full time loving father of 6. Who is being falsely accused of murder with no evidence of him ever being present anywhere in the vicinity of this crime and no other physical evidence. Tommy is a business owner of a junkyard and towing business called Tommy’s Towing and Storage which was left to him by his late father Tommy Whack Sr. since 2021.

 In this case evidence has shown that this crime was stemmed from a petty robbery. A witness gave police statements stating that he drove the perpetrators around after the robbery to buy weed and liquor. Tommy was not named as any of these individuals. Anyone that knows Tommy knows he does not smoke or drink so judge is holding Tommy in jail calling him a threat to the public because of a crime back in 2008. Where Tommy witnessed a murder and was afraid to tell the authorities. Ultimately Tommy was convicted of second degree murder that was later overturned by the appeals court’s. Giving Tommy a time served plea deal sending him home, Tommy was 19 years old at the time of that crime. He is now 35 years old with a business 6 children and a home, and has been a pillar to the community. He is a youth football coach and a mentor.

Tommy has a co-defendant in this case a 19 year old female by the name Audrey Miller. In this case Audrey Miller is the main suspect. Evidence has Ms.Miller with the victim, her phone has phone calls to the victim around the time of his death. Ms.Miller was the last person to see the victim alive. Among other evidence implicating her as the perpetrator , no witnesses have witnessed implicated Tommy. Yet Audrey miller is at home with a 10 o’clock curfew . While Mr.Whack is held without bond for a extended period of time at risk of losing his business. And forcing the children to be split up into different homes. This is both unfair and prejudice.

This petition is to ask the judge to treat Mr.Whack fairly and allow him to be released like they have done Ms.Miller who has no responsibilities or children. Based on the nonexistent evidence that Mr. Whack has committed a crime and all the strong evidence pointing to Ms.Miller, Tommy should be released and not held because of a crime that he has served his time for that happened 17 years ago. Tommy whack is an asset to the community and is not a street thug. When you see tommy he is always with his children.

 Furthermore ,Tommy has been severely mistreated while incarcerated in the DC jail concerning his serious declining health due to server respiratory infection and a blood disease. Staff has continuously neglected Mr.Whack and not giving him proper medical treatment.Tommy has complained to staff about the continues mistreatment to no avail. And is being purposely neglected violating his 8th amendment right being subject to cruel and unusual punishment. For these reasons we ask to release Tommy to his family until his outcome of his case.
