Fair Treatment for the Mountain View Nursery Development
The issue
Mountain View Nursery was built by my family with the dream of greening communities across a vast region — from Sydney to Yass, Jindabyne to Eden, and everywhere in between. For more than five years, we have endured a drawn-out and exhausting battle with Eurobodalla Shire Council that has threatened not only our family livelihood, but also the wider community we serve.
10 months ago Council issued a Development Control Order (DCO) that forced us to close on erroneous and unprecedented grounds. This devastating action cost five local jobs and inflicted immense financial and personal strain. Although the DA was eventually approved, the damage is done — and deliberately excessive conditions continue to block our ability to recover and grow.
Council’s ongoing requirements — sealing the Right of Way (ROW), repeated engineer certifications, and constant DA re-approvals — are disproportionate, unnecessary, and directly contradict independent expert advice. These burdens drain scarce resources, stall growth, and prolong a process that should have been resolved years ago.
Instead of supporting a small business that delivers plants and green life to thousands of households and landscapes across NSW, Council’s actions are strangling our ability to operate and employ.
What we’re asking for
1) A commitment to avoid further unnecessary burdens.
2) Impartial, evidence-based assessment of our DA moving forward.
3) Removal of excessive conditions (ROW sealing, repetitive certifications, serial DA re-approvals) so our approval is proportionate with others.
A fair, timely, and transparent approach that allows us to rebuild, re-employ, and continue serving a broad region.
Mountain View Nursery has poured heart and soul into greening communities and creating jobs. With fair treatment, we can restore what was lost and unlock even greater employment and environmental benefits across the areas we serve.
