The Issue

For countless residents in New York, Homeowners Associations (HOAs) govern not just daily community matters, but also significant decisions impacting property value and lifestyle. However, a lack of transparency often leaves residents feeling powerless and excluded. Personally, I have experienced this frustrating reality when my request as a member of the Board of Directors to allow homeowners to listen in and observe board meetings was shut down . This isn't merely an issue of personal grievance; the broader problem is systemic, affecting homeowners across the state who find themselves shut out of discussions that greatly affect their lives.

The New York State Open Meetings Law, which ensures decision-making transparency in government bodies, should be extended to encompass HOAs. These associations deeply influence residents' lives, often with significant financial and personal implications, yet currently operate outside the purview of transparency laws. It's troubling that decisions carrying such weight can be made behind closed doors, devoid of accountability or resident participation.

By extending the reach of the Open Meetings Law to include HOAs, we can foster a more inclusive environment where residents like myself, and countless others, are granted the opportunity to participate meaningfully in decisions affecting their communities. This legal adjustment would ensure that HOAs conduct meetings in an open environment, allowing all homeowners to stay informed and voice their concerns regarding community matters.

Statistics reveal that HOAs govern 24% of U.S. homes, with New York hosting thousands of these associations. Despite this prevalence, homeowner satisfaction varies greatly, often hinging on transparency and inclusion. A study by the Foundation for Community Association Research highlights that communities governed by transparent HOAs generally exhibit higher resident satisfaction and cohesion. With this background, it's evident how amending the current law can enhance community life for many in our state.

Though a legal petition hardly captures every personal narrative, stories like mine are all too common. Our voices deserve to be heard in the halls where our community’s fate is decided. It's time New York stands as a leader in promoting open governance in all residents' associations.

Sign this petition to call on New York State legislators to amend the Open Meetings Law, ensuring transparent and accountable governance in all Homeowners Associations. Together, let's take a step towards a more transparent, inclusive future for all New Yorkers.
