The Issue

Target: Ministry of Finance, Government of India & Central Board of Direct Taxes (CBDT)

The Problem: Taxing Life Savings in the Hospitals
Medical inflation in India is quiet, brutal, and actively dismantling the financial security of middle-class families.

Even for families who plan responsibly and purchase comprehensive health insurance, critical illnesses and prolonged ICU stays quickly exceed policy limits. When health insurance caps out, families face an agonizing reality: sell long-term investment funds, equities, and other investments immediately to clear hospital bills.

Then comes the second blow.

The government taxes these emergency liquidations under standard Short-Term and Long-Term Capital Gains (STCG/LTCG). A family fighting to save a parent, child, or spouse’s life is forced to pay a tax penalty simply for using their own hard-earned savings to survive.

Why are we taxing citizens for liquidating their own life savings during a medical emergency?

The Solution: An Emergency Medical Exemption under the Income Tax Act
We are petitioning the Ministry of Finance and CBDT to introduce a targeted amendment to the Income Tax Act: exempting capital gains tax on retail equity and mutual fund liquidations when proceeds are utilized strictly to cover critical out-of-pocket medical expenses.

To protect public revenue and ensure complete immunity against tax evasion or fake billing, this exemption should operate on a strict, tech-driven framework:

  1. Post-Insurance Exhaustion Only: The tax waiver applies strictly to verified out-of-pocket hospital costs incurred after existing private or employer health insurance limits are 100% utilised.
  2. Direct Hospital Settlement (Escrow Route): Liquidation proceeds never touch the individual's personal bank account. Funds flow directly from the brokerage/Asset Management Company (AMC) to the registered hospital’s verified bank account against an active final discharge or interim bill.
  3. Automated Real-Time Verification: Instant cross-referencing between the patient’s PAN, the hospital’s verified GSTIN/ROHINI ID, and Demat transaction logs, preventing fraudulent claims with zero manual red tape.

Why This Matters for India

  1. Protects Middle-Class Families from Medical Poverty: No family should be pushed into debt or financial ruin by tax liabilities while clearing hospital dues.
  2. Promotes Financial Inclusion: Retail participation in Indian capital markets is at an all-time high. Guaranteeing tax relief during medical distress transforms every citizen's equity portfolio into an emergency health safety net, encouraging disciplined long-term investing over informal, high-interest borrowing.
  3. Fiscally Responsible & Fraud-Proof: Direct institutional routing ensures that not a single rupee of tax relief is diverted for personal consumption or speculative trading.
