The Issue

I am deeply concerned about the confusion surrounding criminal record check questions on health and social care job applications. Many of these applications include questions that seem out of sync with the current filtering guidelines. For instance, they may ask, "Have you ever received a caution or conviction as a child, youth, or adult?" Without proper context or guidance, applicants might disclose information that is not necessary under current legal standards.

The problem arises because these questions often lack specificity and do not align with the relevant legislation that governs which criminal records must be declared. Under the filtering guidelines set by Rehabilitation of Offenders Act 1974 and its subsequent amendments, certain childhood cautions and convictions are protected and do not need to be disclosed in response to a generic criminal record check question.

This lack of clarity not only confuses applicants but also disregards the intention behind the legislation — to allow individuals to move forward from past minor indiscretions without unnecessary barriers. When hiring practices do not reflect these legal standards, they perpetuate unfair discrimination against those who have moved past such issues. According to Unlock, a charity dedicated to helping people with convictions, there are over 11 million people in the UK with a criminal record, many of whom could be unduly affected by such generic questioning.

It's imperative that job applications, especially within the health and social care sectors, accurately reflect the law to prevent unnecessary disclosure of protected convictions and cautions. This ensures fair and equal opportunities for all applicants, thus allowing employers to focus on the suitability of candidates rather than outdated or irrelevant past actions.

I urge the relevant authorities to review and amend the criminal record check questions on job applications to ensure they are specific, lawful, and appropriate, and that clear guidance is provided to applicants about what does and does not need to be disclosed. We need to ensure that hiring practices are fair and that applicants are not discouraged from applying for roles in this vital sector due to confusion or fear of discrimination.
