Enforce Arizona Laws Giving Legal Guardians the Final Say in DDD Cases
The Issue
I am a legal guardian, facing an uphill battle with Arizona's Division of Developmental Disabilities (DDD) - a part of the Department of Economic Security. As per Arizona state law, in particular, A.R.S. §§ 15-761, 15-763, et seq.; 36-551, legal guardians are entrusted with the ultimate decision-making power. They have the right to protect their own welfare, as well as that of individuals under their guardianship, permitting them to make all decisions regarding legal documents, treatment, and services.
In specific cases, the DDD is supposed to defer to the final say of the legal guardians. However, my experiences, along with that of other guardians, suggest otherwise. Our rights to revise any document that DDD may have on file regarding its members are often overlooked. This not only infringes upon our rights as legal guardians but also infringes upon our rights as individuals.
Paying due respect to the law and its importance in shaping a just society, it becomes imperative for the DDD to follow all legal guidelines regarding legal guardianship. Not conforming to the laws not only defeats the purpose of having legal guardians but also puts the welfare of individuals at risk.
In light of these circumstances, we urge for immediate action to rectify this situation. We request Arizona's DDD adhere strictly to probate laws and uphold the rights of legal guardians, honoring their final say on matters affecting wellbeing. Please sign this petition and help us reinforce the rule of law and safeguard our rights as legal guardians.
