End 90-Day Notice Periods in India — Let Talent Move Freely

The Issue

In India, employees across sectors — especially in IT and product industries — are often required to serve a 60 to 90-day notice period before they can move to a new job. What started as a way to ensure smooth handovers has now become an outdated practice that’s hurting both organizations and professionals alike.

🔴 Here's the problem:

  1. Talented candidates miss out on great opportunities because many companies cannot wait 2-3 months to onboard someone.
  2. Companies are forced to settle for less-suited candidates available sooner, resulting in bad hires and poor productivity.
  3. Employees stuck in notice periods often feel demotivated, unengaged, and even exploited, just waiting for the clock to run out.
  4. During this long wait, candidates either back out or "window shop", leading to trust issues and hiring inefficiencies.

📉 We're falling behind. Countries like the USA, UK, Germany, and Singapore all operate on 2-4 weeks’ notice. Agile economies require agile hiring, and this system just doesn’t serve our fast-moving, globally competitive talent ecosystem.

 
🔁 This needs to change.
We urge the Ministry of Labour and Employment, Government of India, to:

✅ Mandate a maximum 30-day notice period across all Indian companies (except where shorter contractual terms are agreed).
✅ Create clarity around exit timelines and employee rights, protecting both the employee and the organization.
✅ Encourage performance-driven retention, rather than forced retention through long notice periods.

This change will boost job mobility, morale, and productivity, and ultimately help India stay competitive in the global talent race.
