To her honour Lisa Hannan and attorney general Jacyln Symes,

 

I am petitioning and asking you to disqualify Magistrate Luisa Bazzani immediately for:

1. Apprehension Of Bias
2. Advising me to plead guilty on a crime I did  not commit on the 11th of May 2017. I was acquitted of the charge by County Court Judge Sarah Leighfield March 10th 2022.

TO THOSE THAT MAY NOT KNOW WHAT A MAGISTRATE IS.

Magistrates have sentencing powers that allow them to impose a range of sentences, including unlimited fines, bans, community orders and up to 12 plus more months' custody, depending on the offence.

 

MY BACKGROUND STORY

 

In April 2016 I was charged for a crime I did not commit, I had maintained my innocence throughout the years I was on bail and March 10th this year 2022 I was acquitted of the charge.

 

When I was initially charged for the crime my life really went downhill, I had no priors or convictions and was in shock and disbelief that I had lost everything I worked hard for, for something I didn't do.

I had ended up in police custody January 2017 for a bail breach (which I admitted too) and was in police custody (first time) for 4 months until I appeared before Magistrate Bazzani for my bail hearing.

 

My first part bail hearing was on the 24th of April 2017. The informant had given evidence under oath with no material evidence about me and my case (the police brief wasn't ready).  The informant had stated I was a high roller at crown casino and had crown casino's gold card and because the informant had no evidence to suggest I was a high roller, Magistrate Bazzani asked the court room including my sister who was there to support me to google on the internet what a gold card gives you. As time went by Magistrate Bazzani extended my stay in police custody and Magistrate Bazzani told the informant to bring the evidence to the next bail hearing.

 

On the 11th of May 2017 again the informant gave evidence with no material evidence under oath and did not bring the crown casinos gold card that was asked at the previous bail hearing by Magistrate Bazzani,  while Magistrate Bazzani was thinking about giving me bail she confidently and knowingly said "if I was you I would plead guilty".

I firmly believe if my case/trial was heard before Magistrate Bazzani I would have been wrongfully convicted.

The leading prosecutor who witnessed what Magistrate Bazzani had said is now a County Court Judge Hassan.

 

Note***

Victoria Police had changed my charges three times.

Victoria Police had other suspects but decided to exonerate them based on "face value" when there was clear evidence of their guilt.

My mother offered a plea deal before the trial and Victoria Police and the Prosecutor's declined the offer.

During the trial, Victoria Police and Prosecutor's have shown misconduct.

 

The presumption of innocence is a legal principle that every person accused of any crime is considered innocent until proven guilty.

 

If your honour Lisa Hannan represents the foundation and commands the bulk of the structural pyramid of our justice system, then Magistrate Bazzani needs to be disqualified immediately because any member from the community stands before Magistrate Bazzani may not have a fair hearing or could be potentially wrongfully convicted.

Magistrate's Bazzani advice had shown apprehension of bias and the conduct of how our criminal justice system and judicial system operates in Victoria. If we don't hold Magistrate Bazzani accountable she will continue to destroy innocent lives. The question is now, how many innocent individuals did Magistrate Bazzani convict and how many innocent lives had she affected in her time as a Magistrate?

Being falsely accused is unfortunately very common these days however everyone has the right to be presumed innocent by law and it is a common law right.

Prior to doing this petition I had made a complaint to the Victorian Judicial System and have written to the attorney general Jacyln Symes which have both been unsuccessful.

2)Supporting the wrongfully convicted and the falsely accused 

3)And preventing another innocent life being destroyed by our criminal justice system and judicial system.
