Do not apply retrospective ILR rule changes to spouses on family visas

We call on the UK Government to ensure that spouses who have entered or applied to come to the UK via family visas are not unfairly affected by retrospective changes to rules relating to Indefinite Leave to Remain.
We call on the UK Government to guarantee that spouses and family members who have already entered the UK, or who have already applied for a family visa, will not be subjected to new or extended Indefinite Leave to Remain (ILR) requirements that were introduced after they began their immigration journey.
Families make life-changing decisions based on the immigration rules and settlement pathway in place when they apply. Spouses have committed to marriages, homes, careers, finances and family lives in the UK in reliance on the rules governing their route to settlement. It would be fundamentally unfair to move the requirements for settlement after people have already entered or committed to the family visa route.
We therefore call on the Government to provide clear transitional protection for existing spouse and family visa holders and applicants, allowing them to qualify for ILR under the settlement requirements that applied when they entered the route or made their application.
New ILR requirements should apply prospectively to people who begin the relevant immigration route after the new rules take effect, and should not place additional years, financial burdens or other eligibility requirements on families who have already made their life-changing decisions under the previous rules.
Retrospective changes can cause serious financial hardship, prolonged family uncertainty and significant emotional and mental distress. Families who have complied with the law, paid substantial visa and immigration-related fees, met the requirements imposed upon them and built their lives in the UK should not have their expected route to settlement fundamentally changed after the fact.
We believe fairness, stability and trust in the UK's immigration system require the Government to honour the settlement pathway on which existing families relied. Those who have already entered or applied through the spouse and family visa route should be allowed to complete that route under the rules that applied when they committed to it.
