SEEKING JUSTICE FOR JUAN JOHNSON, DUE TO A WRONGFUL CONVICTION
The Issue
From day one Juan has maintained his innocence. He was actively involved in the lives of his family as a provider and protector, a pillar in the community having owned "Off Tha Lot BBQ" which fed thousands of people throughout Colorado. He was also employed with Taylor trucking holding numerous positions under the freight umbrella. On July 21, 2009 he was arrested for murder, still maintaining his innocence Juan plead NOT GUILTY. The first trial for the wrongful conviction (case# 09CR3546) May 6, 2011, the jury was dead-locked and the trial court declared a mistrial. On Sept. 26, 2011 trial two, Juan was found NOT GUILTY of first degree murder after deliberation and wrongfully convicted of first degree felony murder.
His constitutional rights: Amendments 5th and 14th were grossly violated due to an abuse of discretion by the trial judge and prosecutor misconduct. After the NOT GUILTY verdict "UNDER COLORADO LAW," Juan should had been acquitted of the other charge of (Felony Murder) as well. The Colorado Supreme court has reversed a few cases that are very similar to his.
Due to this INJUSTICE we need the support of the public, and with over one million signatures we can get the attention of Governor Polis to correct this wrongful conviction. I'm not a lawyer, but through diligent research these are the errors that were discovered (No charge or conviction of an underlying crime). We have petitioned the Colorado Courts for relief, but was denied on all levels.
Recently, Rogel Aguilar Maderos, a truck driver with over five million signatures on his petition caught the attention of Gov. Polis who granted clemency and commuted his sentence to 10 years in prison after being convicted by a jury for the injuring of over a dozen people, and four vehicular homicides.
The reason for our petition is to be granted a clemency on the merits of Juan's issues, and by doing so his innocence will be proven. we will speak in depth with whomever is willing to assist in obtaining his freedom.
