The Issue

My name is  Tanika Lesesne-Doctor, 

and I'm reaching out with a deeply personal story that I believe echoes the experiences of many families navigating the complex world of special needs planning. My special needs brother depends on me for his care and protection. Recently, I realized we had been misled by legal advisors who were supposed to have our best interests at heart. They guided us toward establishing a special needs trust, suggesting it was the only viable option, without thoroughly exploring all available alternatives that could have better suited my brother's unique circumstances.
This misguidance wasn't just a minor misunderstanding—it was a betrayal of trust by those who were meant to protect us. The lack of transparency and the biased information we received put my brother's wellbeing at risk. This is a reality no one should face.
Legal advisors should be our advocates, offering clear, comprehensive information so families can make informed decisions that truly reflect the best interests of those who rely on us. We should not be cornered into a single option without an understanding of the full spectrum of choices available. This isn't just about my brother; it's about countless families who might currently be facing similar predicaments, unsure of their rights or the optimal path forward. According to recent studies, many families with special needs dependents often feel overwhelmed by limited guidance and support in managing their legal affairs. While special needs trusts can be beneficial, they are one of many tools available. Families must be informed of other legal instruments, such as ABLE accounts, guardianships, or conservatorships, each of which caters to different financial and care-related needs.
We demand that the legal practices concerning special needs planning mandate transparent, unbiased, and comprehensive counseling that highlights all potential options. Legal advisors must be trained and held accountable to provide unprejudiced information, allowing families to choose what genuinely serves their best interests.
