The Issue

We, the homeowners and members of the Towers of Quayside Homeowners Association, Inc. community, a place we cherish deeply believe our community deserves leadership that is transparent, accountable, and responsive to the needs of all residents. Unfortunately, the current Board of Directors has consistently failed to meet these standards and, as a result, must resign immediately.

Under the current board's leadership, our community has experienced a series of concerning issues that have not been adequately addressed. Homeowners have faced rising maintenance fees, lack of communication regarding important decisions, and an overall disregard for transparency. Many of us have sought answers, only to be met with silence or evasive responses.

Our community deserves better. We need directors who are committed to fostering a welcoming environment, maintaining the integrity of our homes, and keeping residents informed about decisions impacting our community. This requires board members who listen to our concerns and take them seriously.

This past Friday, August 7, 2026 at 4:57pm, the board of directors authorized the attached notice sent by email to just the select homeowners/association members who elected to receive e-notices with the following message:

"Dear Residents,

The HOA Board has been made aware of potential health concerns related to a distinct smell in various areas of the spa.

For the health and safety of all residents and staff, the spa will be temporarily closed effective immediately until a further mold investigation has been completed. The mold inspection will be scheduled for early next week and once results are obtained appropriate action will be taken."

The board had been made aware of the presence of mold in our Spa long before Aug. 7th.

In fact, even after being served in writing of a report submitted by a licensed certified mold assessor who inspected The Spa at the initiative and cost paid for entirely by several concerned homeowners which confirmed the presence of mold within our beloved facility, including the HVAC duct work, which we all subsidize to maintain thru our monthly maintenance fees, the board refused to respond to continuous emails asking for, pleading for, and then demanding they exercise their due diligence and take all appropriate and necessary measures and actions to protect the health and safety of all homeowners/association members who they owe a statutory fiduciary duty to as elected directors.

The only action taken by the board was to hire a construction company to remove drywall in just one of the affected areas of The Spa, a racquetball court.
And they initiated this work without ever filing for and obtaining the required County permits which would have brought inspections by the County to insure such work was being done properly and in accordance to the County building code, for the safety of all homeowners/association members the board was entrusted to serve and protect.

Our current, elected board members have severely and audaciously failed to serve their fiduciary duties to our entire association and uncessarily placed all of us in harms way with their actions. They attempted to pass a one year "severance package" at a board meeting which was for the sole benefit of the property manager and of no benefit for our association and numerous residents objected to at this meting and the board was forced to table the vote to approve this folly at our expense.

Then, on May 28, 2026, the board sent out another e-notice  informing the community of the following:

"Community Update from the Board President on behalf of the HOA Board

On behalf of the Board, I would like to announce that this afternoon (5/28/2026), the Board received a letter of resignation from Tom Davis our Property Manager of 40+ years.  His last day on property will be July 27, 2026.  The Board will begin the process of searching for his replacement. A huge thank you to Tom for his many years of loyalty and service to our community. He will be missed."

Since that time, the board has received responses to an RFP and proposals from professional management companies, including KWPMC and Marquis Management, leaders in the south Florida property management field, which they have excluded from consideration, leaving only two companies to chose from which gave presentations at a town hall type meeting on August 4, 2026 which several unit owners in the audience in The Spa and participating on Zoom were denied the opportunity to ask questions of the second company which presented, First Service Residential, when the board Secretary stepped in and stopped the meeting and the Zoom connection was terminated.

Before that, the board voted to approve a questionable contract with an internet service provider, Hotwire Communications, which many residents expressed serious reservations with and would tie our community into a ten-year term when the current provider, Xfinity, has been providing reliable and high speed service to all of Quayside, and there is no urgency to change providers or service at this present time or to tear up our property to install underground fiber optic cable when other options are available.

In addition to reckless spending our precious association funds, we are also are very concerned about the board's underfunding of our current reserves and the dereliction of their statutory required duty to maintain the common areas and amenities of our property.

We have lost complete confidence in the ability of the current board to serve as board members and believe they have put us in both financial and personal peril for our health and safety and the value of our property and quality of life.

WE ARE DEMANDING THEY ALL RESIGN IMMEDIATELY.

THERE ARE QUALIFIED HOMEOWNERS/ASSOCIATION MEMBERS WHO HAVE DECLARED THEIR INTENTION TO RUN AS CANDIDATES IN THE NEXT ASSOCIATION ELECTION.

EACH CANDIDATE IS UNIQUELY QUALIFIED WITH PROVEN SKILL SETS AND ARE ALL READY, WILLING AND ABLE TO STEP IN IMMEDIATELY TO SERVE AS BOARD MEMBERS AND TRULY REPRESENT OUR COMMUNITY AND RESPONSIBLY FULFILL ALL FIDUCIARY DUTIES REQUIRED AS BOARD MEMBERS.

ANOTHER SOLUTION IS TO INITIATE AN IMMEDIATE ELECTION FOR NEW BOARD MEMBERS. THIS WOULD ALLOW HOMEOWNERS TO CHOOSE REPRESENTATIVES WHO TRULY REFLECT OUR COMMUNITY'S VALUES AND PRIORITIES. TRANSITIONAL SUPPORT CAN BE ARRANGED TO ENSURE THE NEW BOARD STEPS IN WITH A CLEAR UNDERSTANDING OF RESPONSIBILITIES AND ONGOING PROJECTS.

The need for change is urgent. Our current Board of Directors has not demonstrated the level of care or competence that our community requires and deserves. It is time for new leadership, committed to openness, integrity, and the welfare of all residents.

Join me in calling for the immediate resignation of the current Towers of Quayside Homeowners Association Board of Directors.
By signing this petition, you are supporting a future where every homeowner’s voice is heard and valued.
Let's bring positive change to our beloved community.

Thank you,

Rick Kosstrin
