Judge Martin overlooked the Petitioners fundamental due process rights which is a clear violation of the 14th Amendment of the Constitution suffered by Petitioner in the court proceedings. Petitioner's counterclaims were not heard by the court even though they were pled and responded to by respondent, depriving Petitioner of a fair opportunity to present breach of contract, personal injury, and constructive eviction claims.  The Petitioner was not even given an opportunity to replead the counterclaims before Judge Martin denied them.  This denial of due process constitutes a fundamental error and violation of rights that can only be the result of incompetence or malfeasance.  Either way it is inexcuseable and Judge Martin needs to be impeached.
