Dear TikTok Legal Department

Without Prejudice 

It has come to my attention and also the Australian media’s attention that the following account is breaching the  Australian consumer laws. 

Key Legal Claims Under Australian Consumer Law (ACL)�
The following provisions are relevant:
* Section 18: Misleading or deceptive conduct
* Section 29: False or misleading representations about the nature, benefits, or results of the program
* Section 21: Unconscionable conduct (e.g. pressure selling, misusing trust, denying cooling-off period)
* Sections 60–61: Guarantees that services will be provided with due care and skill and be fit for the purpose promised
* Section 5(1)(g): Ensures that the ACL applies to conduct that occurred outside Australia if the company is based here (covers offshore victims)
�Health Law and Regulatory Breaches�
There is also a potential breach of health legislation if any of the services provided by Jake Maddock Coaching involved:
* Trauma counselling
* Emotional regulation
* Psychological advice or interventions
�These may fall within the scope of regulated health services, and if Maddock held himself out as providing psychological or therapeutic expertise without being registered, he may have breached:
* The Health Practitioner Regulation National Law (section 116) unlawful to hold oneself out as a registered health provider when not
* AHPRA Guidelines; protection of titles like "counsellor", "therapist", or "psychologist"
* State-based Health Complaints Acts, allow for action against unregistered practitioners causing harm or deception

Jake Maddock coaching is taking hundreds of thousands of dollars from people without performing this service that he promises.  In just one month we have connected to 28 people who have requested refunds of over AU$132,000, without going public. This is the link to his account.

He’s using TikTok lives and content to attract vulnerable people to part with their money. 

We have proof of him being abusive towards women after they sign up for his coaching. He is extremely charismatic and easily uses this to get money off people, and then does not deliver his promise of finding you an ideal partner in 3 to 6 months.  He only offers a 24 hour refund policy which is completely illegal in Australia.

In the last six weeks he’s appeared twice, and been interviewed by an Australian show called A Current affair on Australia’s channel 9. 

The two videos of both episodes appeared on A Current Affair’s TikTok account. 

Many women have come forward complaining of his abusive behaviour and also denying refunds and in fact blocking people when they ask for a refund

He is also giving out all these advice without any qualifications which most recently has included medical and psychological advice which is illegal under the health registration to do without qualifications

I therefore request that you look into his account and at the least suspend and investigate the account, if not ban it to protect your platform and the people on it, so nobody else is scammed by this deplorable man
