The issue
DEAR AUSTRALIANS have you noticed when allegations are serious the evidence seems to be lacking.. and the police investigation is dismal?
Police and Judges like easy convictions and stroking their egos, they do not uphold justice.
I personally am a victim of this, and have being trying to clear my name since 2019 for Convictions in my Absence over my Medically Prescribed Cannabis.
This one miscarriage of justice, cost me my career as my employers where well aware of my medical script.
But once it's on you record, people discriminate against you and your side is never heard.
This started the snow ball of financial, emotional, and reputational damage that is very difficult to come back from..
Take it from me, iv been through it before when I was in Uni and I can admit I was kinda in the wrong.. I got into a fight outside Adelaide Uni Bar, I was put in a headlock by the owner, and resorted to stabbing the guy so I didn't loose consciousness.. now I regret that action, but had I not done that, I may not have been alive today to tell the story. (And no I don't drink)
This was a difficult record to start my life with I was a first time offender, never been in trouble with the law but that didn't matter, I was effectively kicked out of uni, employers wouldnt look at me, I would get great job offers only to hear they pulled it once they got my record.
So I started providing my record first, then my resume so I wouldn't get my hopes up for no reason.. long story short I found compassion in the construction industry and started trying to rebuild my life and build a career.
Fast forward 5 years I find myself in Perth, WA still working in construction and now running my own business Self Employed.
Now I was struggling mentally with the trauma I had endured as I was constantly gaslit for simply defending myself and having the trauma of injustice twisted into claims I had bipolar, that is until I found myself being recommended medical cannabis by my GP in WA, Paul Pittorino, who I will forever be greatful for, even if he's not my GP anymore,
He was the only person who listened to my side of the story and agreed that the psychoactive drugs would not help me, and could possibly make things worse.
After being forced to put me through the hoops of government approved medical cannabis I had a psychotic break of sorts when coming off one of the drugs I was prescribed and crashed my car on my own property (thankfully I was not on the public road at the time)
Paul quickly got me referred to Cannabis Access Clinic in Perth, I was approved and finally found some peace and was able to function and cope with my daily life without wanting to rip my hair out..
As I worked through many traumas that made me the reactive asshole I used to be, (im still trying) I found a common thread was that I was Gaslit by some form of Authority claiming I was the problem?
Well, only a few months after getting my Medical Cannabis approval I found out I was Convicted of Possession in Midland Magistrates Court..
For the record I live in Geraldton, and used to drive to Perth and spend the week there for work.
I never got a day in court, infact I didn't even get a letter that I have a court case requiring attendance.. I was waiting for it, with my doctors statements in hand.
But the court had other plans, they aided and abetted the police in hiding the proceedings from me as no attempt was made to inform me I was being charged with a crime.
So I was convicted in my absence...
The very next day my career was over,
And now I needed a lawyer, which I couldn't afford.
So for the last 5 years now while being made a forced dependant of the welfare state against my will, l have been trying to have my case heard in the Court of Appeal.
For the record, legal aid does not support appeals.
Now that's the first of three matters I have to take to appeals court where police have colluded to hide/manipulate evidence that proves my innocence. They have kept exonerating evidence from the prosecution. And have engaged in malicious prosecutions from the start, I assume, because of my previous record from over 10years ago.
Despite having written statements from witnesses, as well as audio and video evidence of my innocence, I have been on bail for the last year after being falsely charged with assault and having the police conducting an 8man RAID on my home to arrest me, and then again ignoring my rights after arrest (right to call a lawyer etc) so in duress I explained my side to the police and told them I even possess a video of myself being pulled out of a vehicle, assaulted and then choked in a headlock position for almost 30seconds.
Did they ask for a copy ? Nope.
Did any questions I answered that exonerated me make it into their statements? Nope.
Did anyone care I was not allowed to call my lawyer? Nope.
Did they arrest the person committing the assault against me on video ? Nope!
Not even after I went into the police station and made a formal report of the assault with a Uniformed Officer who also viewed the footage in the presence of a witness.. and I just didn't hear back from them.
This footage, alongside other evidence, clears me 100%, but the charges have not been dropped.
Disturbingly, no one in court authority, seemingly including my own legal aid lawyer, has reviewed the crucial witness video, or maybe he had but I haven't heard from him..
And that is also unacceptable, my life is hanging in the balance over a false statement, and I cant even get some basic communication to ease my anxiety?
Just imagine how you would feel?
Would you be angry?
Would you want revenge?
Or would you take it on the chin like I tried to do and still get railroaded anyways?
This is not just my story.
This is Systemic.
It highlights the rampant problem of lack of transparency in law enforcement. Without bodycam footage, accused individuals like myself are left vulnerable to manipulated statements and incomplete narratives.
Police body cameras were introduced as a means to increase transparency, accountability, and trust between law enforcement officers and the communities they serve. However, it's evident that without policy transparency and mandates on releasing footage, these claims fall short.
According to the Bureau of Justice Statistics, 80% of larger police departments in the U.S. were using body cameras as of 2016. However, there's a significant gap in how and when this footage is made available. Reports like mine show that bodycam evidence is often hidden or not promptly released, denying justice to many innocent individuals.
We call for a standard policy requiring police to release bodycam footage of any altercation upon request, especially when allegations are disputed.
This should not be left to discretion.
By implementing this change, we can work together towards a system where justice can be served before it's marred by distorted narratives. We need a system that values truth and integrity, giving every individual a fair chance at justice.
